Our Bill of Rights prohibits the use of torture.
I think the Pentagon's clandestine use of torture in its war on terror is the antithesis of our Bill of Rights:

Article 10:
"Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted."

Although this pertains to our citizens only, by logical extension it should be applied to all humans on our small planet. Of course, Bush and his band of thugs would vehemently disagree with me.

1. If just one of the tortured prisoners has dual citizen status...
... we could probably get the whole rotten bunch of them for multi-decade sentences.

There is waist-deep case law that shows non-citizens aren't protected by the US Consitiution.

Gawd, if there was just one of the prisoners that slipped through that they didn't do research on that shows up as being born on American soil, it's a whole new ball game.

They are saying there are 10,000 people - some Americans - locked up in secret gulags, including Gitmo. Weren't they clear about US citizens not getting rights and calling them "enemy combatants" like John Walker?

presented to the Supreme court regarding the detainees at Gitmo

It was so important Asscraft presented the arguements himself. This was at the same time CBS was holding the prisoner abuse story on the request of Rumsfeld.

I wonder how this would have changed Asscraft's arguements should the story had been broken already.

It would be pretty hard to argue why the US should be allowed to define them as enemy combatents not subject to the laws of the US while they reside at a US facility

these guys are war criminals.

they have disgraced this nation by their actions.

they should be removed from office, tried for treason and convicted. some should face the gallows.
