2. Well that might not be bad....I think sometimes think these case's like
Mc Donald's hot coffee should not have gotten as much as she did... now if it is things like losing a leg or some other part of your body in medical mistakes, then much, much more....

4. If you check into the facts of the McDonalds case...
it is not nearly as ridiculus as it is made out to be by the anti-consumer tort reformers. She was perfectly willing to settle for something reasonable to cover her medical bills (those were 3rd degree burns after all), but McDonalds wouldn't settle, so it went to trial.

5. Tort reform
re medical issues is a non starter to me.

I am walking around on a bad foot due to miscare when I was 28.

No there should be no limits!

there is no intentional harm and no gross negligence.

But a judge isn't going to impose punitive damages unless he thinks there is at least gross negligence, anyway.

Bush would really put on caps, Kerry is just trying to sound moderate on the issue.

7. Medical Malpractice Cases....
aren't settled overnight. To prove malpractice is almost impossible. My mother died due to a OBGYN's mistakes. They gave her the WRONG blood type! They gave her "A" type and she had RH Factor. My father was in the courts for over 15 years with this!

I had sinus surgery. 6 months after the surgery, my bones started to calcified over my eyes and I had to had more surgery, by another doctor at the U OF M. The second doctor told me that the first surgeon did not complete the surgery correctly. To cover my medical costs, I sued. It took over 7 years to even get it to court.

This malpractice thing is a farce! What they need to do is put out better doctors and make them accountable.

Look at the poor woman in the Cities, they removed her breasts! They had the wrong woman! There was nothing wrong with her!

UGH!

10. not to mention the cost of malpractice insurance has gone up
in states where caps have been imposed, and stayed level or gone down in states with no caps.

One of the dem reps did graphs on this during the floor hearings this year.

The two variables are completely unrelated, as unrelated to lawsuits as the cost of medical care and medical insurance.

Tort reform is about protecting the interests of corporations and nothing else.
