1. Without getting into the nuances of the law regarding this . . .

I will attempt to state this gay marriage stuff simply:

1. all the states constitution amendments will fail if challenged to the U.S. Supreme Court, and
2. the Defense of Marriage Act (DOMA) will fail if challenged to the U.S. Supreme Court.

However, it will take time for such legal challenges to occur and more time as the legal challenges wind their way up to the U.S. Supreme Court. All of this is known by intelligent rightwingers (yes, there are one or two of those) which is why they wish to add a federal constitutional amendment to change our federal constitution in order not to have 1 and 2 (above) happen. Are you with me here?

Running with all of this is the political hype to the ignorants who get all lathered, hot and bothered. It sells. It gets votes. Kerry lost, correct? Bush won on this shit. And, the worst part of all of this is that some (gay) folks (and their kids) get hurt badly as we all wait and wait some more as the cases wind their way up to the U.S. Supreme Court.

The sole caveat to all of this is: George Walker Bush may change the U.S. Supreme Court with idiots who will agree with all the gay hate and bashings, and uphold the states constitutional amendments and DOMA. In other words, the idiot in the Oval Office wants to pack the U.S. Supreme Court with religious ideologues.

edited to include: For an informative Q&A about "same sex marriage - what the hell is it all about in Massachusetts?" here's some resource material at http://www.glad.org/marriage/massmarriage_faq.shtml

. . . . . . . . . . . . . . .

2. Oregon already filed
I didn't read the whole article, but they filed this week. So this is going to throw a wrench in the works right quick.

4. Bingo.
That is precisely why I spent day in and day out working to get Kerry elected, rather than on defeating Ohio's amendment that has an immediate personal impact on my life. If the supreme court stays the same or adds Kerry appointees it doesn't matter what trash they pass as laws or amendments - they are unconstitutional. On the other hand, with a Bush packed court decades of marital jurisprudence will be thrown to the wind and the statutes and amedments will be found to be constitutional.
