Kerry, Obama and Election Certification

Here's a question after hearing Conyer's interview on Olberman:

Will Barack Obama or John Kerry be in the Senate when the Presidential election results are brought foward? Any chance that one of these two senators would stand with congressional democrats in refusing to certify the election results on the basis of voting irregularities in OH and FL?

That would keep * from being inagurated, right? Or is this all moot because of the concession - but this obstruction could be accomplished without the consession, no?

Just thinking out loud - i hope some hardcore investigation is going into this and the Dems throw up a big roadblock.

<ON EDIT>
For all of you procedure buffs: If a senator and representative both fail to certify the results, then what? Is there a broader vote, or must the results be unanimous?

Sorry so many questions...

I thought he'd be inaugurated at the same time the president is. I mean don't they all "start" at the same time?

Now Kerry will be there because he's already a senator. That's agood point. But if that were the case why didn't Al Gore not certify the election himself?

I know too little about the details of how all this works. But you've raised a good question.

4. He wasnt a senator... only president of the senate...
could only vote in case of a tie - no other real voice (IIRC)

in January when the next congress convenes.

3. That is what I am not sure on...
I thought I heard someplace that Obama would have the opportunity to pass on the results. My understanding is that the senators are sworn in, then one of their first responsibilities is to certify the prez election - I dont think the certification is done by lame duck session.

6. I thought that was the case too.
Senators are sworn in somewhere during the first week in January, IIRC. Then the election results are certified, and the president inaugurated in late January.
