Anyone have a photo of Blackwell they own the copyright to?

Anyone have a photo of Blackwell they own the copyright to?
I just got a job to do an internet ad for http://recountohio.org to run on a newspaper web site so I cannot just steal an AP photo. The owner of recountohio.org did not understand the copyright issue. I gave him contact info for an AP photog that shot Blackwell in Oct. but that will only work if AP photog does or can say yes to his request.

3. Government documents are not copyrightable....
You should be able to easily request an official State photo and use it without copyright issues. Any photo on the gov't site would be considered official, and not subject to copyright.

It is refreshing to see someone who IS concerned about copyright! It is rare.

4. I work for a newspaper and we know we cannot use news photog's
photos for advertisers. The problem with the photo on Blackwell's website is he is smiling. I'm hoping for a smirk or a scowl.

A plain reading of the federal and state statutes would seem to indicate that government-owned material is not copyrightable, but the relevant authorities informed me that particular provision is interpretted to mean that people cannot copyright materials used by the government (e.g. city seals), not that governments themselves (e.g. state of Ohio) cannot own copyrights.
