Updated: 5:49 p.m. ET Nov. 26, 2004LOS ANGELES - A man accused of planting a keystroke recording device on a workplace computer wasn't violating federal wiretapping law, a judge has ruled.



Larry Lee Ropp, 46, was indicted in March on charges he installed such a device to obtain e-mails, passwords and other information from a computer used by the secretary to the vice president of an Anaheim, Calif.-based insurance company.

1. There are security tools to detect these things.
That is why it is prudent for any IT Admin to use those tools with some regularity.

I think it's ridiculous to say it's wiretapping if the recording takes place after upload, but not if the recording takes place from keyboard to computer.

(ON EDIT: I don't know how the law is written, so maybe the judge interpreted properly, but if so, the law needs to be changed)
