what on earth is happening??? This gets me sooo riled!!

edit to update voting total: now at 21 yeas, I understand this is a 15 minute vote, so I guess the totals will continue to change, but one can see the trend, and I don't expect it to change. I guess, once again, the Dems are rolling over!!

22. yes, this can be found to be unconstitutional BUT
it has to go into the judicial system (now the federal judicial system) to be found so. Tomorrow, both the parents and Michael Schiavo will file separate lawsuits about this. Schiavo will probably file to have the law declared unconstitutional, and the parents will file to have her feeding tube reinstated, while this works its way thru the federal court system. Probably, both cases will be decided by one federal judge. The first issue that will have to be decided is the constitutionality of this. So this will be the first hurdle. IF it makes it past this hurdle, ultimately it will wend its way to the Supreme Court.

41. my understanding is that one federal judge will be presented with both
suits. First, he/she will have to decide the constitutionality of the law before the Schindler's case can proceed. If the judge says it is unconstitutional, the Schindler's case stops there. A lot of legal scholars are saying it could well be knocked down. We'll see... Guess tomorrow will be another day to see the judicial branch in action! Should be interesting...
