Anyone know how long it will take a Federal Court to review Schiavo Case?
Will this be a short review or will it take weeks?

Sorry to post another Schiavo post but I am so burned up about this I am about to move to Canada. The Republicans looked like a fucking Alternative High School loosing debating team tonight. Who the fuck votes for these clowns!!!!

2. Hopefully the Federal Court will tell Congress where to stick it...
That's what should happen. But I really have no clue.

18. If so, then win-win for * and Delay. They'll say this is THE reason
why Congress should approve *'s choices to fill the federal bench with more "common sense" judges.

3. quickly, unless they issue a temporary stay
but I don't see how that's possible now that the tube has already been disconnected. The court has to order a new operation. It's more difficult than if they had acted before Friday.

This is only a guess, I'm no lawyer. The DU legal minds will know far better.

5. There's a chance that the parents....
.........will try to get the Feds to order the tube reinstalled while the issue is being litigated, and that's where they'll hit a wall. No sane Federal judge will declare that all of the Florida state courts lacked jurisdiction.

Of course, I never dreamed the Supreme Court would anoint Ratface in 2000................

4. The parents will request an expedited ruling
I hope they get it, because I'm betting that the Feds will toss it right away.

Oh, and in answer to your question about who votes for those fucking clowns, I'd say fucking clowns vote for them.

Just a guess.

7. I am at my Dad's house tonight and he has cable so this is the
first time I have watched C-Span in quite some time but I have to tell you I was absolutely stunned at what light weights the Republicans were tonight. I mean I am simply just blown away! Is it always like this? The only Republicans who sounded like they had any brains and depth were voting against this insane Bill.

14. Congratulations..............
You're getting a big lesson in how stupid our elected representatives can be.

Just think of the people who voted for them.

6. Hasn't the whole process
of death already been started and her body beginning to shut down? No one is talking about this. Even if the feeding tube is put back she could be worse off.

9. The feeding tube was out for a week the last time
I don't want to sound cruel but how can you damage a Vegetable any worse than before? Isn't that like an oxymoron? She was practically brain dead before now she is a just brain dead with a parched mouth.

Not trying to be funny. Just stating a fact.

8. If the judge goes by the constitution, about ten minutes
If the judge is prepared to throw all judicial jurisdiction questions to the Congress, decades.

12. since the issue is at the federal level, consitutionality must play a role
To the DU lawyers: Isn't that correct?

15. there is no variety of venue..not two different states involved, my guess
is the Federal Court will dismiss it, i.e. refuse to hear it because it's not a federal matter.

16. so the only constitutional issue would be the 10th amendment?
and whether the federal court even has jurisdiction in the matter?
I heard Schiavo's lawyer said this case had already been to the US Supreme Court three times. Do you know if that is correct?

17. Seperation of powers
The Congress cannot adjudicate court cases when all other avenues have been utilized.

Congress has usurped the power of the judiciary.

20. That's a key point.
My son & I discussed this when I drove him to school this morning. We are supposed to have a balance of powers at the federal level. There is an intended system of checks and balances to keep any one branch from becoming too powerful. At this point, the legislative branch is improperly interfering with the judicial, not in order to keep it from being too powerful, but as a tool of the executive branch. The legislature is being used to deconstruct the Constitution.

I'm all in favor of an orderly discussion of values in America. Let's have an open and very frank discussion about the value of human life. Let's put the cards on the table.

But let's do it within the framework of that great document.

19. Fed court
So how many of us on here believe that Tom Delay has probably already spoken with the federal court that will review the case, and threatened them into ruling a certain way?

That's the thought that keeps running across my mind. It's probably already a done deal.
