because it is not a constitutional issue and not a law of the US meaning a federal law. there is no federal law here.

this case asks the court to decide what Terry would want. The court heard the evidence and made a decision which has been upheld.

31. My original thought was that this was an ex post facto law.

Somehow I get a feeling there's some judge they'll find who will hear this case and order some kinda stay...just to help their political bosses save face here. I don't think the wingnuts in DeLay, Inc. would go this far if they didn't think they could cook the books at least on the District Court level.

Or, maybe, just like the Clinton case, now the case will be appealed (yet again) and some panel (packed with Repugnicans) will make some ruling that will send this thing to the Supreme Court. Fortunately there I expect this sham to finally end, but in the meantime it will create more manufactured news for the corporate media, red meat for the Repugnicans with their fundie base and continued agony for Michael Schiavo and millions who face a similar plight.

3. It's too bad it wasn't a Republican judge. The Republican judge, assuming
that the judge isn't some corrupt Federalist, would have shot this down also. In fact the judge, in Florida, who most recently ruled on this case, is a Republican judge.

10. My guess (and I could be wrong)...
...is that if the judge pinpointed a time--he's all ready made his decision and that decision will be that the feeding tube remains--game over.

Scheduling a time leaves him little room for investigation, etc. I think he made a swift decision that this entire debacle was unconstitutional.

Again, maybe I'm wrong, but that's just my sense.
