it's a different situation this time. I beleiev that the last time they rejected it because it was outside of federal jurisdiction. Not so this time.

i expect he will reject this one also based on Roe and Elian cases which are some of the more famous ones.

maybe if someone can or wants to do a research on his decisions and opinions on other issues we might get an idea of whether he will reject the case.

11. isn't Kennedy the only one to decide on whether they will take the case ?
based on the area they are from. and from what i remember with the Elian case.

30. "cert", abbreviation for "certiorari" - just means they agree to take the
case. Takes 4 votes and SCOTUS usually does not grant cert in these kinds of cases (state law and definitive rulings the highest state court - Bush v Gore was a huge exception, of course).

28. Four votes would mean they WILL take the case (grant cert)
It only takes the positive votes of four justices to grant cert - meaning, take the case. But given Scalia's bias toward state's rights, Bush v. Gore aside, I don't think he would vote yes, so I think they will not get four votes.

You should all have a living will to prevent this from happening to you in the event of a catastrophic illness. A living will very simple to do and your wishes will then be followed.

38. I made a living will in 1999
just pulled it out and re-read the thing. I just sent my two adult children an email informing them where I keep it. I was going to give them copies, but if they don't have the original I don't think this would this would stand up in court. My daughter knows where I had this originated and they have their master copy.
