If you haven't read the decision, you should, at least the first few pages, which is all I have read as I need to get to work.
The court cites the debate in the Senate between Sens. Levin and Frist about the temporary restraining order. Levin says, basically, he will object to the legislation if it requires the court issue a TRO and Frist assures him that the then current (and the one they passed) version of the bill did NOT require the federal court order the tube reinserted while they offer a new trial.
So,the issue of whether the federal court had to insert the feeding tube while it gave "Terri" a new trial was discussed by the Senate and it was decided the court did not have to.
So, when you hear Delay and the likes scream that the federal court had to insert the feeding tube to carry out the will of Congress they are lying through their teeth and reading even the first few pages of the decision will prove it.
