I so don't want more discussion of Terry Schiavo, buuuut, Re: Judges
Is it possible that this whole thing is being trumped out of proportion by the Republicans, so that they can mobilize their base when it comes time for important judicial appointments?

I mean, it's gonna be "All the good people in congress tried hard to save her life, but the activist judges let her die. We need to re-make the judicial branch of the government."

I'm getting a little nervous about this.

(sorry if this is an old point, which I'm almost certain it is, but I've been trying to avoid the subject for months).

1. But this action on their part seems to be doing the opposite.
It is mobilizing the 70% or so of the country who want the neo-fundies to stay the hell out of our lives. It may be what they planned, but I think it has back-fired across the board.

3. I sure hope that's true!
But mobilized fundies are very powerful as we've seen several times the past few years.

If, however, the 70% who don't want to see the fundies rule, recognize the plan, then we're in good shape because it will show that the judicial is now the only moderately effective check to the other two branches now run by mostly right-wing wack-jobs.

5. The only thing we can hope for is that the neo-fundies

4. It's hard for me to see how they can call the Schiavo judges "activists"
Upholding previous court decisions; upholding the legal concept of a husband to be legal guardian to his wife (which even upholds the sanctity of marriage, if you will); taking careful legal steps like appointing a Guardian Ad Litem and an independent neurologist to study the matter closely--these are all actions that follow the law, and don't veer from it in any way. I'm not saying they won't try to use the buzzword to fire up their unthinking followers, but it's a very tenuous argument.

8. Right. And the presiding judge is a Republican
and a Southern Baptist (who has been ejected from his church). This just makes all of the "Neanderfundies" look like idiots - or worse. When Southern Baptist Republicans are not "conservative" enough, who the hell is?

6. I think that is their point, but the point is just stupid.
If judges hadn't intervened, she would have been dead 7 years ago. It was her parents that used the judicial system to delay it this long.

Without judges, the hospital would have just asked Michael 7 years ago and that would've been that. Instead, a long string of court cases instigated by the parents dragged this case out forever.
