Is the current GOP plan to eliminate the judicial branch of government?


Death threats to judges, decision after decision being called "activist" when it doesn't agree with the radical right clerics... is the judicial branch the next American institution to fall?

I think the religiously insane nut job wing wants to destroy any judge who serves the law instead of the neotheocon agenda (which is any jusdge that actually does her or his job).

5. RWs have an organized campaign to eliminate judicial power
Whenever the wingers want to work something, the start off with their framing phrase. The code words this time are "judicial tyranny." Lots of different RW propagandists are using that phrase, and identical arguments. One is, "Why should unelected judges have the last word?" They are also repeating RW myths about judges being liberal. There are lies that the Supreme Court is deciding cases based on foreign law. They are using any lie they can think of. The wingers aren't trying to undo Roe v Wade anymore. They are trying to undo Marbury v Madison.

The winger propaganda is accompanied by calls for Congress to take away the jurisdiction of the federal bench, hence the power of the judicial branch overturn the Congress. The threat isn't being taken as seriously as it should be. Most people don't believe Congress can do away with the jurisdiction of the courts. Under Article III section 2 of the constitution, Congress can do just that, and with a simple majority vote, except where the Supreme Court has original jurisdiction. Findlaw has a long list of cases that were decided by the courts in favor of Congressional power to do this. Its been done many times before. I don't think they've ever tried to do away with all judicial power before though.

The wingers have been saying for a couple of months now that the executive branch doesn't have to obey the courts. The calls for the executive branch to intervene in the Schiavo case are based on this propaganda. Its not just a few wingers that believe it. Most of them are already trained.

I take this threat very seriously, and consider this part of their efforts to make America a Fascist nation.

I think that the fundamentalists are trying to do exactly what they've been trying to do since the 80's with the republican party. Eliminate the moderates and replace them with radical right wingers. Luckily, its a bit more difficult because even most conservative judges are there because they believe in the rule of law and do not want the judical powers watered down in any way. So, not all of them bow to the ravings of the far right in all rulings. Still, given enough time, the fundamentalists can certainly do a lot of damage.
