Court inaction spurs vows of conservative retaliation

"When this tragic episode is resolved, the Supreme Court will have some serious questions to answer about its silence and arbitrary interpretation of federalism, but those questions will have to wait for now," Mr. DeLay said last week after the court refused Mrs. Schiavo's parents' request to reinsert the tube.
Outside interest groups also see a confrontation coming.
"I think this is going to set the stage for an eventual showdown between the branches of government," said Tony Perkins, president of the conservative Family Research Council. "This tragic event just brings it to a climax."
Democrats said Republicans appear to be trying to change the rules because they didn't get the outcome they sought.

5. Heard some whack-job on NPR...
... this afternoon ranting about defunding the courts, and taking away the lower courts' ability to hear cases, yada-yada.

The courts have been an activist bunch in favor of the right and a lot friendlier to the right and to business in the last twenty years than in a long time. But, it's just not enough for them.

The federal appeals court heard the petition as their law required and dismissed it. Now, the right doesn't like the result, so they're going go after the courts.... Mr. DeLay and Co. better be careful--the courts may go after them....

6. DeLay had his own personal hypocrisy on this issue exposed tonight....
he's blown their case for outrage....he and his family did the exact thing they accuse Schiavo of doing and they filed a frivolous wrongful death lawsuit to boot.. He's lost all his credibility.

10. Oh, his office is trying to do damage control...
... saying that the cases really weren't similar, etc., and no, Delay wasn't really involved in the lawsuit and didn't even know of its progress at the time, yada-yada.

But, with luck, the LA Times will keep after the story--most have forgotten by now that something happened between he and his mother that caused him to refuse to see or talk to her from years ago to the present time, and it's just possible that some yet to be unearthed details of this story, or of the lawsuit, perhaps, may have been the cause.

And, with some luck, Ronnie Earle will get someone to talk about DeLay's role in moving money into and out of his PAC to launder it, and DeLay will be French toast. :)

19. Delay's going to be poison come the 2006 elections. Remember how Newt
Gringrich's negative image was used to defeat Repug congressional candidates back in the 90's?

Look for Delay to be "Newtralized".

9. Given that the full appeals court...
... provided a 10-2 decision to dismiss, yeah, they might be a tad annoyed.

But, truth is, the courts could cause no end of trouble for both Bush and Congress. They could tie up Congress for months and months just by accepting cases having to do with, say, the Medicare bill, or the Patriot Act and striking essential provisions of those on Constitutional grounds. As for the Bushies, they only have to order the full and complete release of the energy task force papers to create a Constitutional crisis. They ought to be doing these things, anyway. But, even those old, dried-out conservative judges are gonna balk at Congress trying to cut their nuts off.

What was it that Chief Justice Marshall said? "It is precisely the function of the judiciary to say WHAT THE LAW IS."

Or something close to that.

That case involved an early constitutional showdown. Delay & Co. are punks by comparison. Hell, they're just punks anyway.

Conservatives inside and outside Congress are vowing a showdown with the federal judiciary over the Terri Schiavo case, as Republicans say courts at all levels have flouted congressional subpoenas and legislative intent that her feeding tube be reinserted pending a final decision in the case.
"They have defied federal law. And this confrontation now is the confrontation between the Constitution, the Founding Fathers, the will of the people and the judicial branch of government," said Rep. Steve King, Iowa Republican. "Constitutional authority will either be imposed upon the judicial branch of government, or we might as well board up the Capitol and turn this country over to the whims of the judges."


But the right wingnuts will believe it and parrot it.

Unconfirmed sources report that the President and Republican Congressional leaders have publicly apologized to the Schiavo family for taking advantage of their suffering to score political points. The extraordinary press conference has held at the White House and featured direct apologies as well as a tearful plea for forgiveness from the President himself. Teri Schiavo's parents could not be reached for comment as they were too busy begging the courts to reinsert their daughter's feeding tube.

"I'm real sorry," stated the President through tears of remorse. "we Republicans have done a bad thing. We've taken advantage of your family's suffering to score points with our pro-life conservative base. We have been so hypocritical in fighting for your daughter's life, while at the same time we try to cut the funding that pays for her care. It's sad. We are just a bunch of political grandstanders who don't really give a damn about your daughter, but are simply using you and her for our own ends.

"I'm proud to be Republican." Said Senator Joe Lieberman. "I'm proud to belong to a party that knows when it is being manipulative and hypocritical and has the inner strength to admit it. Sure we are using the whole Schiavo thing to whip up the American public into a mindless frenzy, but what is wrong with that. "

so at least Delay recognizes that Bush V Gore was an outlier that either never should have happened, or should have been a precedent.



i truly hope the Judiciary comes together to give the smackdown (or perhaps "The People's Gavel") at every turn.
