"What you need to know about the new FairPay Overtime rules"
Just got my new labor law posters about two weeks ago, and the FairPay overtime rules were included. Apparently, if you have an employee that earns more than $11.37 an hour, you can exempt them from overtime pay, and even the FLSA minimum wage requirement, provided you can qualify for an exemption. Here are some of the exemption qualifications:

"Professional Exemption: The employees primary duty must be the performance of work requiring advance knowledge, defined as work which is predominantly intellectual in character and which includes work requiring the consistent exercise of discretion and judgement"

that isn't, like, vague or anything. naw.

more: "Administrative Exemption: The employees primary duty includes the exercise of discretion and independent judgement with respect to matters of significance."

the whole poster is about 18x24, includes a happy-feel-good photo in the top right hand of some office workers, and is just about as vague as one of those magic 8 ball thingy's.

additional wording: "Job titles do not determine exempt status. In order for an exemption to apply, an employees specific job duties and salary must meet all the requirements of the Department's regulations"

just thought i'd post this, it looks like Corporate America and Bush's first attempts to begin the undermining, and destruction of the Fair Labour Standards Act.

2. Oh god, there goes overtime for the poor suckers at Wal-Mart.
You know those men and women who throw boxes all day and clean the warehouses. If you are in any kind of supervisor job, Wal-Mart is going to take away your overtime. Now Wal-Mart employees will not only be on Medicare but they will join the lines for food stamps, WIC, reduced lunches...

3. And Wal Mart will give certain employees just enough pay
to expemt them, then work them 80 hours a week.

5. yeah, that's what i was thinking.
you could claim that Jim the Janitor "uses discretion" and "exercises judgement" so therefore, he has to stay an extra ten hours a week to put an extra wax coat on the floor, and he just gets 50 hours at $11.37, instead of 40 at $11.37 with an additional 10 at $17.06.

pretty friggin' sick. hopefully one a' them "dayyum radicalist activeeyist judgesh" will do their job, and rule this as inconsistent with FLSA, and thus strike it down.

4. Job Descriptions Now Being Re-Written
to say "Employee is expected to consistently excercise discretion and judgement blah blah blah".

The end of overtime.

6. This whole bill was aimed primarily at health care workers
from certified nursing assistants all the way up to pharmacists, registered nurses, respiratory therapists, and all varieties of technician. Hospitals and HMOs are desperate to cut the costs that are eating into their profits, and the easiest place to do that is on the backs of human beings. Mandatory overtime (meaning extra 12 hour shifts per week) is already in place; now they won't have to pay for it.

8. That why one of the major CEOs of a HMO said
before the election, "How is not the time" when asked about RNs and their OT... Bush gets re-selected and How IS the Time.....

Sad, but one of my Repug friends is an RN with a heavy Repug husband... I am just going to love it when they have her working 50+ hours a week no OT.

9. i think the hospitals are taking it in the backside from the
insurance companies too, so that may what is eating into their profits, as well as the human cost.

what is mandatory overtime?

we should write a book, here's a title: "The Complete Idiots Guide to using Doublespeak on a propagandized, misinformed, and easily distracted populace"

excerpt: "completely transparent government" - the populace only needs to know what we decide they need to know. additional: who cares what they think, we have domestic and global agenda's to fullfill.
