I keep reading the dems want to offer a deal, to avoid a nuclear option threats on eliminating the filibuster from the republicans.

Do they think this will stop them? They WANT to go nuclear, eliminate the filibuster so they can rubber stamp anyone into the SUPREME COURT..check and mate!

the dems are falling into a trap. why is it they can not see it?

1. Let's go over this slowly
1) The judicial filibuster position of the Republican leadership has NOTHING to do with the current nominees and EVERYTHING to do with the Supreme Court nomination.

2) Therefore,

a) The current judgeships under consideration are a sideshow
b) The Republican leadership will not accept ANY deal that keeps the filibuster in place or acknowledges ANY capacity for the minority to block judicial nominations.

3) Moreover, the Republican leadership has already "pulled the trigger," as it were, in that they have set on the course of removing the judicial filibuster capacity of the minority. They cannot turn back now without losing face and angering their base.

4) So, the Democrats can make any offer to avert the rule change, the better the offer (which, for reaons 2a-b and 3 will NECESSARILY be rejected, the worse the public appearance of the Republican leadership to moderates of all stripes.

That's the game plan. Will it work? Who knows? But don't pretend like the Democrats are actually offering confirmation of these five judges. They are only offering something that the Republican leadership, given its aims, objectives, and current trajectory, CANNOT POSSIBLY accept. They CANNOT. It is impossible for Frist to now stop the momentum of this thing. Hell, I say offer passage on SIX of the SEVEN. Frist cannot accept that either. He can't even accept SEVEN of the SEVEN if the capacity to mount a judicial filibuster remains intact.

3. ..exactly..why do the dems keep playing this stupid game then?
Edited on Fri May-20-05 10:08 AM by oc2002
they have to come out and calling them out. If they want to be bullies, the dems have to fight back, the worst thing they can do is keep handing them their lunch money.

The dems need to call out to the media that this has never been about the judicial nominees, its all about the power of the president, and the republicans to ramrod anyone they want, any bill they want down the Americans throat, and consequences be damned!

GOD, how blind are they!

5. I would agree with you except for the fact that...
the Republicans aren't really in a position to accept anything we offer them. If they really go nuclear the dems can come out roaring and for the time being they can make the Rupublicans look unreasonable by offering deals which the Republicans can't accept.

2. Personally, I'll be very disappointed if the Dems negotiate.
It seems to me they've negotiated away any rights we might have as a minority party. When you consider that this country is split 50/50, we keep getting a rotten deal. It's also obvious to me that the Republicans think they'll remain in control for a long time to come.
