Big Valerie Plame News to Break Tomorrow
On Thursday, the SCOTUS met to decide whether to hear the Valerie Plame appeals (the ones brought by Matthew Cooper and Judith Miller regarding their refusal to identify their sources before the Valerie Plame grand jury). The SCOTUS's decision, in all likelihood, will be announced TOMORROW, as it is the last opportunity for the Court to announce decisions on cert. petitions this term.

2. Let's hope that is what it is.
If the Court rules consistently with its prior opinions, it will rule that the journalist cannot protect their sources if their sources were accessories to the commission of the crime.

It is the SCOTUS decision that Fitzpatrick is waiting on.

That's what we want. The Court turns it down, and the journalists are facing jail time. They testify to stay out of jail, and the indictments start flying. The Court turning it down is bad for Rove and Co....

12. They testify in grand jury, the government will forget it, and the
deep throats will be intimidated. Novak outed Plame. Why has his testimony been discarded? He has named names.

Do you have some secret source on the grand jury or in Fitzgerald's office?

What has happened is that Fitzgerald has been waiting for ALL the testimony before proceeding with the first round of indictments. If necessary, he will then wait until he has ALL the testimony from those trials to bring a second round of indictments. That's been his MO for a long time in Illinois, and he used it to walk all the way up the chain and bring down a Republican governor. He never "forgets" anything. Unless you've got some inside pipeline, I think it's probably best to reserve judgment.

10. in a time of war, i wouldn't be surprised
specially considering who's on the court and recent decisions goin the neoCONs way.

this is certainly a biggie, though and they have ruled against the neoCONs on National Security issues as well i.e. GITMO so i still got my fingers crossed.

8. This kinda scares me. From reading John Dean's articles
it seems like all they need to do is have 4 Justices agree to put this on the docket, which I think they have, then they can push this case off until after the 06 elections, so they can maintain their majority status in Congress. By then we should have another neocon Justice sitting on the bench, which could mean that they hear the case and rule in favor of Miller and Cooper because they have one more vote for Dubya. I've been thinking about this and I really believe that's the game plan, put it on the docket to buy some time, and then stack the deck to get a favorable ruling, then the case dies. I really think the Plame affair is "THAT" big and thats why I think they will do everything they can to kill it. If all goes well, they will decide not to hear the case, and possibly things will move forward. I have my fingers crossed.

If they don't hear the case, she goes to jail.

If they hear the case, they're forced to rule against either Bush or against free press.

So they'll SAY they're going to hear the case. But they'll delay hearing the case for as long as they can.

Stalling keeps the White House accomplice in the Iraq WMD lies (Judith Miller) out of jail.
