Internet graphics and copyright laws?

When is it and is it not permissable to post up others photos or graphics?

Do they have to be marked as copyrighted material for public posting to be forbidden?

1. I think the link itself is attribution of ownership.
I just wouldn't put them on tshirts you're trying, or things like that.

Since I do it pretty regularly

Course I make my own too.

But I think the question is if you are making money off of them or if you are weakening the value of them (which is a grey area, obviously). Or if they are disney which sues like it was a bodily funtion, apparently.

If I see a picture on somebody else's Page, can I put it on my Page?

Generally speaking, no. The person may have created the image just for their Page or paid someone else to draw it, it may be licensed for their use only, or it may have been copyrighted and shouldn't be on their Page, either. With the exception of free graphics sites, you should always send an email to the owner of the Page, asking permission before taking any graphics. Note: Be sure to ask if they are the artist of the image; some folks apparently don't understand that they have no right to give away somebody else's work.

An image is automatically copyrighted at the moment an artist creates it, whether or not they formally register it for copyright. The copyright generally belongs to the artist. Some exceptions would be if they did it while under employment (in which case it may belong to the company), or if it was of a famous person, in which case depending on circumstances, the celebrity may claim ownership of their image, or if the photographer/artist was a government employee and took the photo as part of their job. But generally the artist owns the image, whether it's a photo or graphic.

Thus any image you find on a website is generally copyrighted, and it doesn't need to state that explicitly - it's the default. Some websites have a statement that the images are in the public domain, or they have a common use license. An example would be defenselink, which says:

"All of these files are in the public domain unless otherwise indicated. However, we request you credit the photographer/videographer as indicated or simply "Department of Defense."

It's your job to look at their website and find a statement like that before using or distributing the image.

5. 99% of the time I right-click and save to my own bandwidth
then say ..found at www.whateverthesitewas.com..Most sites do not mind the re-use of their stuff if you do not steal their bandwidth.

The internet is like a gigantic postcard..able to be read by anyone who picks it up.

People who do not want their stuff "recycled" can disable rightclick..

And people who don't want their house robbed, can lock the door.

Leaving your door unlocked may be stupid or negligent, but it is NOT a legal waiver for people to enter your home and strip it of all belongings.

Unfortunately, there is no technical way to prevent people from taking any graphic or image off a website. Disabling right-click only keeps out casual users who wouldn't want the image anyway, whereas anyone with just modest HTML skills can work from the source code to find the location of the image and download it from the file directory. It takes less than a minute.

In addition, there are any number of reasons why you would not want to disable any mouse commands. It messes up accessibility for the vision impaired, it risks serious page errors for incompatible browsers, and it pisses people because they can't do any of the perfectly valid actions that are "right-click" controlled.

it doesnt have to be marked as copyright to be copyrighted material.
any original creation is copyrighted.
It is not permissible to post others photo's or graphics.
You had better not be doing it in a commercial setting.
As a private citizen using a image for non-commercial ends you can get away with quite alot,but that is due more to ignorance and lack of enforcement than the legality.
I would say it is harder to argue "fair use" for a image or graphic than for someones writing.
but i am not a lawyer :)
