Couldn't the Delay indictments fall apart?
I know that what I'm about to mention has all the appearance of smoke from his legal team, but it does sound possible that he was improperly indicted on a conspiracy charge for an offense committed at a time when there was no conspiracy law covering what he did; and he may wiggle out of the new money-laundering charge if he manages to retract his waiver of the statute of limitations with regard to that crime.

Will some lawyer come and hold my hand and tell me not to worry and everything will be alright and the Buggyman won't come and get me?

No effect on the conspiracy charge?
George Dix, a professor at the University of Texas law school who is an expert in criminal law and procedure, said he doesn't believe changes made to the Texas election code by the 2003 legislature have any effect on the conspiracy charge.

The penal code's conspiracy charge allows for the charge if the defendants allegedly conspired to commit any felony, including an election code felony.

Just because the election code was “silent” on the penal code provision until 2003, it doesn't mean it wasn't a valid charge before 2003, Dix said.

“To me it just says, ‘We really mean what we said implicitly before,’” Dix said.

I have to agree that this indictment could fall apart and it has absolutely nothing to do with the evidence that is strongly building against him.

He's an neo-conservative repuke who has built his career on lies and deceptions and has done an excellent job of doing so. If anyone can worm there way out of this hardcore evidence against him it's Tom Delay.

But hopefully by recognizing this truth the case against him will be even stronger. I'm sure that Judge Earle is aware of while a sneaky slimehole this Delay is and will have all the bases covered unless....


Bush pardon's him

(yeah it could happen)

As far as I know the only use for our constitution is toilet paper in the white house bathroom

9. He can only pardon FEDERAL charges
The president cannot pardon state charges. He does not have that power or authority and only an amendment to the constitution can alter that.

Just pointing out the obvious - constitution means nothing to Bush.

Anyhow, can't governors pardon too? Not like Rick Perry has issues with Delay - hell Delay is the one that gave him a repuke legislature

3. Jeez, relax.
There are professionals handling the matter. I don't give these things five minutes thought.

Remember, if Delay gets off, then the scandal changes. It's no longer about the law being broken. It's about how weak and toothless the law is that someone can launder money to get around it.

6. Focus On The Foregone
According to the issue of Time about to hit the streets, the tacit word inside the Beltway among leading Republicans is that there's no way he'll get his job back as Majority Leader. According to the piece I read, the position is very cannibalistic. Even if the charges were dismissed or he were acquitted by a jury, the best he could hope for would be to hang onto his seat.

Regardless of what happens in Sugarland, I take this is goooooood news.
