Swift Boaters soliciting funds to fight lawsuits
(excerpt of e-mail message sent to supporters)

John O’Neill Houston, Texas

Dear Friend,

Last year, when my fellow Swift Boat veterans and I spoke out about John Kerry, you rallied to our side. We will never forget your faith in our cause and your belief in our honesty. It made all the difference. Together we made history.

Like most of you, I believed our mission was over. We could all move on with our lives, return to our families and homes secure in the knowledge we had done the right thing for America, and for our children’s future.

Regrettably, that has not been the case for a distinguished group of Vietnam combat veterans who stood shoulder-to-shoulder with us during last year’s campaign. Their situation has become so critical that I felt compelled to break our long silence to inform you of this urgent matter.

The Vietnam Veterans Legacy Foundation, an organization founded by some of the same POWs and their wives who joined with us to form Swift Boat Veterans and POWs for Truth, has become the target of vicious legal assaults – multiple lawsuits designed to silence the voices of the POWs.

The VVLF is being sued to punish the organization for the content of the POW documentary Stolen Honor, which contrasts their own accounts of their service in Vietnam and suffering in North Vietnamese prison camps with the claims of the antiwar movement.

They desperately need our help and I am asking, once more, for your support. I urge you to give what you can to assist these truly noble men and women.

14. Kenneth Campbell is suing them for defamation
the info comes from a swift boat type website:

July 15, 2005 -- The Vietnam Veterans Legacy Foundation has set up a legal fund to defend Carlton Sherwood, creator of the Stolen Honor documentary, from a lawsuit filed last fall by former VVAW member Kenneth Campbell, who appeared at the Winter Soldier Investigation with some unlikely claims about shelling peaceful villages in Vietnam. Now Campbell thinks that Stolen Honor has defamed his good reputation by suggesting he isn't the war criminal he claimed to be.

Campbell is suing them for the documentary Stolen Honor and it looks like they are suing Kerry because Sinclair broadcasting wouldn't show it.

It is a little confusing.

So that means none of them, individually, will lose anything.

But, I'd settle for having them put the hell out of business.

Discovery, though, could lead all the way back to their money guy, Richard Scaife, and wouldn't that be fun? I suspect that might be what was behind the original defamation lawsuit, since it's file in the Eastern District of PA, which is where Pittsburgh is, which is where Scaife is.

28. Can they not be sued both jointly and severally?
An individual is still responsible for their own libelous statements, even when acting under a corporate umbrella.

I'm not sure how being incorporated would protect them from a libel cause of action.

Love the phrase "Kerry surrogate."

It's another VVAW guy who feels that Stolen Honor claimed he lied about what he saw in Vietnam, even though he wasn't in the film. Hmm. I don't know if that will fly. But neither do I see how they can claim it was Kerry's doing.

As for suppressing Stolen Honor, gee, I thought that was us (grin)

This is the first I've heard about it. I wonder if it isn't a con to get money out of their supporters.

I hope it's true. There ought to be a good case against them. They sure lied a lot.

They seem to want me to believe that Kerry and this Campbell guy volunteered to go to Vietnam on dangerous assignments, serve with distinction, and then they returned and lied about their service to make the military and themselves look bad.

You'd need to be pretty dumb to fall for that.

Seems like 5 lawsuits so far

1) Carlton Sherwood, Red, White and Blue Productions, Inc. and Vietnam Veterans Legacy Foundation v. John F. Kerry and Anthony T. Podesta...........On October 3, 2005, Carlton Sherwood, Red, White and Blue, and the VVLF filed suit in Federal court (Defamation, Defamation/Business Disparagement, Intentional and/or Negligent Interference with Prospective and Existing Contractual Relations, and Civil Conspiracy Complaint, filed in Eastern District Court of Pennsylvania) against Sen. John Kerry and Anthony Podesta for events relating to the suppression of the documentary film Stolen Honor.

2) Jon Bjornson, M.D. (called a John Kerry Surrogate by the RW) v. Carlton Sherwood and Red, White and Blue Productions, Inc., Vietnam Veterans Legacy Foundation (THE BOARD OF DIRECTORS) and NewsMax.............A "Winter Soldier" has brought a lawsuit claiming that he was libeled by Carlton Sherwood's documentary Stolen Honor. In a complaint filed August 25, 2005, nearly a year after Stolen Honor was released, a man named Jon Bjornson alleges that Stolen Honor implied he was a "fraud and a liar" who made up stories of atrocities by US soldiers in Vietnam in order to deceive the American people (John Kerry relied on Bjornson's and others' accounts of war crimes and atrocities when he testified before the Senate Foreign Relations Committee).

3) 08/25/2005: Libel and Slander Complaint, filed in the Court of Common Pleas, Philadelphia County, PA .....Kenneth Campbell v. Vietnam Veterans Legacy Foundation and NewsMax and

4)Kenneth Campbell v. Carlton Sherwood and Red, White and Blue Productions, Inc.

On October 18, 2004, the plaintiff, Kenneth Campbell, filed suit claiming he had been defamed by Stolen Honor. Campbell is shown for a few seconds as he appeared more than 30 years ago at the "Winter Soldier" hearings held in Detroit, Michigan by the Vietnam Veterans Against the War (VVAW), where he testified about war crimes and atrocities that he said he personally committed or witnessed while in Vietnam. Campbell now alleges that Stolen Honor implies that he lied about those war crimes and atrocities.

5.)George Butler, Swift Boat Film, LLC and Winter Film v. Sinclair Broadcasting, Red, White and Blue Productions, Carlton Sherwood and John Doe 1-62..............On October 21, 2004, a copyright infringement lawsuit was filed in New York City by George Butler and others claiming that they owned the copyrights to the documentary films "Winter Soldier" and "Going Upriver: The Long War of John Kerry" and other photos used in Stolen Honor. Plaintiffs allege that defendant Sherwood was infringing those copyrights by using portions of the films and other photos in Stolen Honor, and that Sinclair Publications would also infringe on the copyrights if it showed Stolen Honor on its television stations around the country. The plaintiffs sought an injunction that would preclude the defendants from using excerpts of any of these works in any manner, including by showing Stolen Honor on the Sinclair television stations. The plaintiffs also sought unspecified damages and attorneys fees, including the disgorgement of any and all profits realized from Stolen Honor.

33. Gannett News team (inc. Sherwood) Pulitzer for 1980 fund raising scandal
Sherwood is best known for his work on a 1980 series investigating a fund-raising scandal involving the Pauline Fathers, and the Vatican's role in covering it up. The combined Gannett News Service team won a Pulitzer Prize in public service for its reporting that year.

Here's to the plaintiffs involved in the lawsuits, may their attorneys argue well, may the judges and juries prove favorable, and may the defendants lose all the way through the appellate court systems.

Here's to the people who contributed to the so-called "Swift Boaters" in the first place--May Divine Light and their stricken consciences guide them to open their wallets not to the defendants, but to the impoverished and the refugees both here in the US and abroad.
