So why would 30 attorneys general embarrass themselves before the Supreme Court? Answer: Because their publicity stunt would never get any real scrutiny. Miller's flimsy legal arguments always got a free pass from the media.

Miller's latest assertion - she waited a year to hear Scooter Libby's waiver was sincere - is the latest in her litany of headscratchers. It's not too late to subject the New York Times reporter's statements to a reality check. This would be a first.

1. "Forty-nine states, all but one state, in our country have now given journalists' sources protection under the state law or by judicial action.. So the federal standard is really out of whack with what the will of the states is at this point." News Forum with Gabe Pressman (WNBC New York) June 19, 2005

But 49 states would never excuse Miller from testifying.

3. A different take ...

Through all of this, I have not noticed anything that disuades me from my opinion that she she's not protecting anyone, rather that she is promoting herself. I suppose that's a form of protection, but from a different perspective. Miller is getting an incredible amount of attention and has been since this all started. Her incarceration sets up opportunities for book deals, exclusive interviews, and all sorts of things that will advance her career or fill her bank account no matter what happens to her or anyone with whom she is associated legally.

Her comments, and more specifically her presentation and apperance after her release just emphasize this for me. This is a career move.

heroine. Some journalistas and others who otherwise were critical or shied away from her dropped that in the face of her "courageous" stand on the first amendment.

Could it her (and Coopers) reasons had more to do with stalling the Grand Jury? If Miller and Cooper had not fallen back on their rights as "journalists" to protect their sources the GJ may have come down with indictments a year ago, just in time for the '04 elections.
While yes going to jail is extreme she knew ahead of time she would only be held for 3 months, so maybe the question could be just how much 3 months of JM's life was worth vs. how much winning was to the RNC.

7. She is a scam artist and a shill for Bushco.
She was protecting herself. She was told that she might be spending another 3 months or up to a year in jail if she did not testify. Also, a deal was struck that she would not have to answer any other questions except those pertaining to Libby. That was what she was waiting for. A month from now she won't be big news. Then in a few months her book will come out. If indictements come down her book will not a big seller.
