2. The voice I trust on this is that of a man who served on the
jury that indicted Delay - he was responding to a reporter's question about whether Earle's prosecution was politically motivated. The man on the grand jury said 'no, Earle has stacks and stacks of evidence.'

a grand jury in the state of Texas would indict him if they had no evidence? Bugman & Co. are throwing tons of shit against the wall hoping something will stick.

4. Shouldn't. They have proof there was a list, just not the list itself.
That's like a murder trial where you have a knife wound but no knife. You know the victim was stabbed, you know a murder was committed. You just don't have the actual knife that did it. If they have enough other evidence linking the accused to the murder, the actual knife wouldn't matter.

In the DeLay case, for instance, they have the equivalent of a witness who saw the murder, then who saw the murderer throw the knife into the ocean, but they don't have the knife itself. Think they have enough evidence? The jury would, too.

The mothpiece said, "Earle has no magic beans. The magic beans are the key to the whole case. What kind of partisan hack prosecutor could possibly bring an indictment without the magic beans?"

According to Rush Limbaugh, "In the entire history of the universe, no Texas prosecutor has EVER gone to trial without magic beans. Earle HAS NO MAGIC BEANS folks!"

(And if Earle does find some magic beans, next week it will be a lock of Rapunzel's hair.)
