The Big Day:

I can't think of any reason for Fitzgerald to put anything under seal -- unless he's offering his targets the opportunity to turn themselves in before it turns into a real circus over there.

So, two suggestions for the folks staking out the courthouse:

* Even if he seals everything, Fitzgerald would have to take any indictments returned by the grand jury to a judge today. And he would be accompanied by his grand jury foreperson. So keep an eye out for that.

* Also keep an eye out for senior administration officials showing up at the courthouse very, very late at night.

But he just doesn't have the background in killing bugs to pull it off: saluted instead of smiled.

2. I hate to rain on your parade, but VERY FEW atty's work nights!
The criminal ones do when their client gets arrested, but I can't believe this judge or Fitz is planning on any OT tonight!

Get yourself razy tomorrow and Friday, but relax tonight.

4. Poop
When I was a youngun clerking for a judge and later on an assistant prosecutor I spent many a late night at the court house. I quit when I didn't see my baby daughter awake for entire week because I was leaving for work so early and coming home so late.

When I was a judicial clerk, I spent a number of late nights at the courthouse.

6. Fitzgerald may not be planning to work
But the attorneys for the accused might be. However, my meager experience is that anything the folks indicted might want to file, they wouldn't file at the courthouse after hours. Their attorneys, who are well known to the court clerk, will probably just contact the clerk and deliver anything they need to have filed to the clerk personally at home.

That's the way it worked for a while in the District I live in (the rationale being that the courts are technically never closed). I don't recall if it was a new presiding judge or a new court clerk who decided to put a stop to that, but it's made federal practice a little easier.

9. Top aides at the WH are gonna get special treatment.
Don't you think?

I don't really expect Federal Marshalls to show up at the White House or Rove's home. The bad guys are gonna come in and present themselves, why wouldn't they try to make an arrangement for doing that in the wee hours of the morning?
