David Schuster is talking about conspiracy....
But if he indicted Libby for conspiracy, there would have to be other indictments, wouldn't there? You can't be in a conspiracy by yourself!

2. the term unindicted coconspirator comes to mind.
It does take two to tango (unless you wish to risk looking really stupid on the dance floor) but the authorities are under no obligation to indict each and every participant.

in a crime, if they are knowing or not I would think you are conspiring to commit a crime.

David Schuster is not doing the indictment.
Not even Fitzgerald is doing the indictment.
The grand jury does the indicting.

I'm pretty sure that the federal statute requires that at least two people actively participate for there to be a conspiracy. However, the poster above may also be correct that the mere attempt to induce others would also lead to a conspiracy charge (in the way that, say, people who attempt to enlist undercover agents in a murder for hire plot can be charged with conspiracy even though the undercover agent was never truly involved in conspiring).

That said, it is possible that Libby is charged with conspiracy with the proviso that other conspirators will be revealed at a later date.
