2) I think he's finally serious. I think that's because he knows that the public is not at all on the side which would use the filibuster to block a nomination. It violates an inate sense of fair play held by most Americans which requires each candidate get their vote. I think most Democrats are beginning to understand that the use of the filibuster would work seriously against their cause. Which may very well be why Frist is finally serious.
