Deadline for DOD appeal in torture-FOIA case is tomorrow midnight
ACLU has just informed me that Judge Alvin Hellerstein has given the DOD a one-week extension (from Nov. 15) to appeal his ruling to release the remaining photos.

Should be some news tomorrow.

2. I'm not holding my breath. Again.
ANOTHER extension? Why? This is bull.

But on a POSITIVE note:
Thanks for staying on top of this issue, wtmusic!
Your update is greatly appreciated, as always.

3. Hey, anytime
You have to love the ACLU. Without them this would be going nowhere.

4. And what happens if the DoD decides simply not to release them?
Who's going to make them...Bush?

I fear this will become another "John Marshall has made his decision; now let HIM enforce it!"

5. well....
then it comes down to the Dept. of Defense defying a contempt citation.

I don't think they would go that far. Prediction: photos will come out, and though heavily redacted, will be the turning point for getting the hell out of Iraq.

7. Let's hope so. But I don't trust these people when cornered,
but I really do hope that they would comply if ordered to once and for all.

11. Actually yes....but I really hope it doesn't come down to anything like
that. I just don't trust these people though.

13. Oh, it will.
Don't ever think that the criminals from this Administration will ever give up. Ever. This is the kind of a weed that must be ripped up from the roots.

6. They'll probably appeal it clear to the Supreme Court.
Each time waiting until the last minute to file, therefore taking more time for it to wend it's way through the courts.

8. GEEEEEEEZ! How many extensions are they going to get? They
wouldn't be stalling this in hopes of Alito being confirmed for when they appeal to the SCOTUS? Nah! Silly me. :eyes:

10. I understood they didn't appeal it

The judge granted an unasked for extension in case they wanted to extend it.
Sounds like an activist judge to me.

12. The judge's latest decision
doesn't sound very friendly to the Dept. of Defense.

If they can't pull a constitutional issue out of the hat, we may get our photos.

14. So what happened?
It's now the 23rd of November as I ask this question. Anyone hear about whether the government appealed?
