Granite Bay Couple Sues Website Over Evolution

A Granite Bay couple is suing the administrators of a web site that helps educators teach evolution, claiming it improperly tries to influence religious ideas.

Jeanne and Larry Caldwell argue the University of California-Berkeley website, called Understanding Evolution, is an effort "to modify the beliefs of public school science students so they will be more willing to accept evolutionary theory as true." They say that because the site gets part of its funding from a goverment grant from the National Science Foundation, it constitutes a government endorsement of religion.

According to an attorney for the university, the courts have repeatedly rejected the argument that teaching evolution is teaching a religious idea.

2. evolution isn't a religion
it is a scientific theory. Next I expect them to sue the National Weather Service because they didn't say that Katrina was the wrath of God or something....

The Caldwells say they are not supporter of intelligent design, which is a theory that living organisms were created by a higher intelligence, but they do object to teaching evolution as scientific fact. (emphasis mine)

From Wikipedia:

Quality Science Education for All (QSEA) is a non-profit creationist foundation focused on challenging evolution as taught in public schools.

Part of the intelligent design movement, QSEA has been involved in legal disputes over science textbooks used in classrooms in several states, including Minnesota, Texas, and California. Other notable actions include Caldwell v. Roseville Joint Union High School District, a case brought "so that citizen proposals to implement 'Quality Science Education' in their local public school will be considered on their scientific and educational merits, rather than on the basis of pre-existing prejudices and bias."

QSEA is operated by the husband and wife team of Larry and Jeanne Caldwell, of Roseville, California. Larry Caldwell lists himself as founder and president.(emphasis mine)

What won't these folks do to promate their agenda? And when will they understand that their efforts demean and undermine both science and faith?

Free speech is one thing, but a law suit?!

Gee, the conservative church down the street selectively uses Bible passages ot influence people. Can I then sue them?!

They are NOT argueing that the facts are incorrect,
they are seeking to have the facts surpressed
because they are UNPLEASANT to them.

It's just not enough for them to stick their fingers
in their ears to avoid the truth;
they don't want anyone else to hear it either.

Sure, it sucks to be WRONG,
but grownups get over it and move on.
These emotional infants file a lawsuit
to force everyone else to be wrong as well.

Federal Rule 11:

(b) Representations to Court.

By presenting to the court (whether by signing, filing, submitting, or later advocating) a pleading, written motion, or other paper, an attorney or unrepresented party is certifying that to the best of the person's knowledge, information, and belief, formed after an inquiry reasonable under the circumstances,--

(1) it is not being presented for any improper purpose, such as to harass or to cause unnecessary delay or needless increase in the cost of litigation;

(2) the claims, defenses, and other legal contentions therein are warranted by existing law or by a nonfrivolous argument for the extension, modification, or reversal of existing law or the establishment of new law;

(c) Sanctions.

If, after notice and a reasonable opportunity to respond, the court determines that subdivision (b) has been violated, the court may, subject to the conditions stated below, impose an appropriate sanction upon the attorneys, law firms, or parties that have violated subdivision (b) or are responsible for the violation.
