1. Just how would you suggest that be done?
Who would sue as "plaintif"?
What laws would you cite as having been broken?
What claim would you make, in terms of injury or damage?
How would you collect what you're after?

2. Why the Inquisition? Why in the world would it be any different than
any other suit.

I don't know if any have been filed, but there should be suits filed against the media outlets that have promoted and sold this war to the American public.

3. How 'bout a shareholders' lawsuit for negligent destruction of the
brand name value of their news organizations?

I'd like to see someone go after Diebold and ES&S and Sequoia on a
"defective product" class action.

9. I would suggest it be done immediately!
A progressive foundation or the ACLU, Mediamatters etc. could press it on behalf of any slandered party. The claim would be slander or a violation of the Truth In Advertising laws.

You have lots of questuions in response to my question. Do you have any answers?

that I wouldn't enjoy seeing F*X News slapped with a big lawsuit...or O'Reilly, Limbaugh and Coulter go down....

But realistically, I think it would be tough going...for reasons including those posted in this thread by others.

Never meant to throw water on your enthusiasm or to patronize....

4. They're allowed to lie.
There was a case some time ago about Fox News, I think, knowingly lying on the air. The court ruled that they were under no obligation to tell the truth and could not be held liable.

I'm not a lawyer, so I don't remember the case name or the particulars, but I'm sure someone here at DU will remember it. I believe it took place in Florida.

6. I don't really think it could be done, except for faux news.
And even that's tough because they are cable, but I was thinking their slogan 'fair and balanced' is not only blatantly false, but also false marketing. If even one piece of merchandise is marketed with their insignia and that slogan, then I would think it would fall into a false marketing bucket. Then we can sue to keep them from putting that slogan on any of their merchandise.

Now that would be somethin, wouldn't it? :)

He could start with the RNC. But im sure hes waiting for Fitz to conclude his investigation.

would probably have firmer legal standing...taking the slander tack.

As far as most of us here wishing for the Bush water-carriers to be punished for the lies they helped perpetuate, we'll probably have to settle for watching the bad-MSM venues punished in the court of public opinion (and therefore lost advertising revenues, where it'll really hurt them.)
