Want To See What's Wrong With The Justice System?
Edited on Wed Nov-30-05 07:33 AM by ProfessorGAC
Here's an article from the Chicago Tribune regarding an indictment handed out yesterday for the murder of a young girl.

http://www.chicagotribune.com/news/local/chi-051129nicarico-story,1,2549215.story?coll=chi-news-hed

This guy CONFESSED to doing this more than 15 years ago! But, the mafiosi in the DuPage Country prosecutor's office had already railroaded two guys who DIDN'T DO IT! Those guys WHO DIDN'T DO IT, were on death row, so that Birkett and his henchmen could claim a high conviction rate and "strong on crime" nonsense.

So, they let those two guys rot, because this guy, who CONFESSED to doing it (did i mention he CONFESSED) wouldn't admit it on the stand unless they would take the death penalty off the table. Now, we've had a DP moratorium for more than 2 years, and they STILL wouldn't bring charges against a guy who admits doing it.

Railroaded two guys who didn't do it! Can't admit a mistake. Won't indict and try a guy who admits to doing it, because they wouldn't get to kill him.

The prosecutors lied to the court. The prosecutors lied to the victim's parents. The prosecutors lied to the defense team. The prosecutors lied to the public. And, two guys went to jail who didn't do the crime. And, somehow real criminals still hold office.

Dreadful abuse of the system. No justice in this scenario at all.

3. He Was Tried For Malfeasance
Unfortunately, the buffoons in DuPage acquitted him. Apparently, as long as we railroad Hispanic folks, it's not really breaking the law.

7. Oh, thank god they weren't black.....
:sarcasm:

Seriously, that was my first thought when I read the story...

I bet it's a couple of black kids...

11. He should have been tried for attempted murder...
seriously, what is the difference between a prosecutor, or a witness, or a cop, who will lie to KILL someone who is innocent, and a cold blooded killer?

12. The Answer, Solon, Is Nothing
Except they got away with it, while two guys who didn't do it went to prison. A distinction without a difference.

5. We the people pay for everything!
One way or another!

Reminds me of the NAZI kangaroo courts. I look for the meathooks and piano wire any day to cut the budget a little!

6. Not What I Meant, Hubert!
I wonder who ELSE is paying the buffoons in the DuPage County prosecutor's office. What special interests have these guys in their pocket that they were so set against doing the right thing as opposed to that which would advance their careers.

I have suspicions that there is even more to this sordid affair than meets the eye.

13. Just politics, maybe?
People like that think more about their political careers and their public image, than they think about their fellow countrymen's lives. The man simply don't want to look bad by admitting he's made mistakes, it seems to me. Sound like anyone else you can think of. Those guys on death row mean about as much to that prosecutor, as the kids dying in Iraq mean to Bushco.

It's sad to see the country being trashed from every angle. The justice system is in sad shape indeed.

Keep us posted on this case.

14. Can Do
I think this is pretty much it, though. There is no DP in Illinois right now, and there's no public sentiment to drop the moratorium. This guy DID it and admitted it. So, the conviction is a slam dunk.

But, if anything unusual happens, i'll be sure to let you folks know.

8. Whats new?
Theres been two justice systems for a long time now. One for the rich and famous. The other for the rest of americans. Guess which ones make up the majority of the prison population. When people like OJ, M jackson and R. kelly walk away from court cases that the average joe out there would have been found guilty of, (in a lot of cases with little or no evidence, most are there because of one or two witnesses) and more or less forced to take plea bargains by their lawyers. People need to stop watching shows like Law and Order that shows the legal system in this grand the innocent will be freed by due process BS and go down to the nearest court house and watch how justice is really dealt with. When the prisons are filled with people that were forced into plea bargains by the whole court, trust this when you have a judge telling you that its in your best interest to cop a plea or he will give you a harsher sentence when your found guilty, (notice, when found guilty, not if found guilty) 90% of the people will take the plea. Its not about justice anymore its about convictions and getting the prisons filled that drive the system. I am not saying that all that are sentenced are innocent, I'm saying that the courts are unfairly balanced and a person isn't innocent until proved guilty, its guilty until proved innocent. How many times have we seen cops come on TV and say time after time, I know this man did the crime and we are going to get him? How many times have they then learned the guy that they were so sure of turned out to be innocent? Isn't that proof positive and speaks volumes about how the real court system works?

15. Well look at execution 1000 in virgina,
the guy was taken off death row and given life without parole because they destroyed DNA evidence by ''accident''. Yeah right, evidence that might have set the man free was destroyed so now he gets to rot in prison until he dies. Thats justice.

10. Symptomatic of many things wrong with our country
So much of what happens these days is done because of how it will "look" instead of whether it is right or wrong. Tragic.
Thanks Prof

20. That murder was a horrible, horrible thing. The pros. rushed (&lied) to
convict because people were freaked out.

If that little girl hadn't been left home alone, it likely wouldn't have happened. I'm sure the parents guilt about that has caused them great suffering.

21. You're Probably Correct
However, responding to a freaked out public and convicting the wrong guys is not justice. It's convenience.

23. Both Of Them
Lots of Hispanic people in Aurora and lots of the lily-whites in Naperville were fearing that they were getting too close in proximity to the "darkies". So they had to do something about the "incursion" i suppose.
