Fitzgerald is interested in the conversations V. Novak had with Robert Luskin, attorney for Karl Rove. The blogosphere is having some difficulty getting its head around this one. There is no problem here with 'sources' releasing reporters to testify and there is some confusion over why Fitzgerald might be trying to get around the attorney-client privilege that Luskin's discussions with Rove obviously has. But, so far, there are four suspicions floating:
V. Novak can substantiate Rove's claim that he "forgot" about his conversations with Matt Cooper, V. Novak's colleague at Time.
V. Novak' s conversations with Luskin were about Rove's 'forgetfulness' BEFORE he said he 'forgot.'
V. Novak was told by Luskin that Rove knew that Matt Cooper was going to testify to facts that Rove had lied about to the grand jury, which was the reason why Rove wanted to go to the grand jury a fourth time under oath and 'correct' his prior testimony.
a. might do Rove some good in his defense;
b. certainly won't and could lead to perjury charge(s)
c. might not help, since, according to bloggers with legal backgrounds or advisors, if a witness wants to 'correct' his testimony, but already knows that another witness will blow away his earlier testimony as lies, it is too late to correct and perjury charge(s) can still result. But then there is:
Fitzgerald is trying to legally break the attorney-client privilege by forcing Luskin to testify on what he said Rove told him to do to fight back, which might be outside the normal work that an attorney does for a client. In other words, if Rove is/was using Luskin as a part of the whole POLITICAL response to the investigation, that might not be protected conversation.
Like I have said several times, this case will get very strange before it is over. Some bloggers are suggesting that Luskin has hurt his own client by appearing on TV too many times and giving tips to Fitzgerald. Also remember, in a-d above, there is always e. - None of the above.
