Stop Diebold in CA Petition *** (This one is from "Speak Out California")

Text of Letter to be sent to SoS Bruce McPherson:

Diebold machines must pass the hack test

Ensuring that counties in California are equipped with secure and reliable voting equipment should be the No. 1 priority for your office. Nothing is more important than protecting the most fundamental right of democracy: Everyone gets one clear and fair vote.

If the Diebold electionic (sic) voting machines you are currently considering re-certifying continue to fail a truly independent test and aren't proved to be secure, you have no choice but to refuse to re-certify this machine and wait for one that works. As your constituent, I am urging you consider these three points:

1. The machines absolutely need to pass a fair hack test.
2. Security and reliability are more important than the January 1, 2006 deadline set forth in the Help America Vote Act (HAVA).
3. The Secretary of State must work with the state Attorney General to reassure counties that they'll be protected from Department of Justice attacks.

With the very integrity of our elections system at stake, we can't afford to have 17 counties in California -- including Los Angeles, San Diego, and Alameda -- using faulty, non-secure Diebold machines.

Millions of Californians will be watching this issue closely, and we will all work to hold you and your office accountable for making the right decision.


"Electionic" is a typo, a Freudian slip, or a newly-coined word. The body of the letter can be edited, if you wish. ;)

9. Just the hack test? Needs to be more secure than that.
This letter has a good intent, but it does not go nearly as far as it should.

For these machines to be approved, Diebold needs to supply source code and have the machines COMPLETELY open for inspections.

I can see a situation where the machines pass the "hack test" and are subsequently "updated" thus nullifying any testing. These machines must be open for public inspection at ALL times or they will not be reliable.

10. We must do *what* we can *while* we can.
The HAVA deadline is January 1st.
According to California Election Code, voting machines must be available to those wishing to test them.
That's what's on the books NOW. McPherson is in violation of this Code, Section 19202.

12. Finally, people are waking up.
I rememember when one of the principals of Speak Out California was on this board arguing that MacPhearson was a good guy and that there was nothing wrong with Shelley being attacked.

13. I not only couldn't understand that line of thinking, I suspected those
who voiced it of being from the "other side".

I hope something can come of it. Looks to me as though McPherson is at least in violation of 19202 and 19205 (c)
