to be charged with a crime in order for prosecutors to depose his doctors to see if he went Dr shopping

FORT LAUDERDALE, Fla. - If Palm Beach County, Fla., prosecutors decide to charge Rush Limbaugh for his prescription drug use, they'll have to do it without questioning the conservative radio host's doctors about his medical condition, a judge ruled Monday.

Prosecutors can subpoena Limbaugh's physicians in connection with a "doctor shopping" probe, but can't ask them many meaningful questions unless the Palm Beach resident has been charged, Circuit Judge David Crow ruled.

If prosecutors charge Limbaugh with illegally obtaining overlapping prescriptions from different doctors, his physicians can be subpoenaed and fully questioned at a deposition, hearing or trial, Crow wrote.

Prosecutors are investigating prescriptions Limbaugh received from Florida and California doctors between March 2003 and September 2003, when he allegedly picked up 1,733 hydrocodone, 90 OxyContin, 50 Xanax and 40 time-release morphine pills, search warrants show.

Limbaugh, 54, has not been charged with a crime.


So, has his attorney finally pushed the prosecutor's hand? I'm so ready to see this am-hate radio Shrub propoganda machine get what anyone else would have already gotten.

Besides, I'm really enjoying the "Indicted Republican of the Week" emails I've been sending out to everyone on my list. They're crooks, get over it!

The charges of doctor shopping have only been used a few dozen times in the history of Florida. And only in connnection with other more serious charges. If he was an ordianry person they would not be after him.

3. I hope this isn't a legal form of "chicken"
and that the prosecutors don't blink. If for no other reason than to clear the air, they should indict. Then they can find out if the alligations are true. Has Rush stated that he abused the drug? If not, I would think he would demand a trial to clear his name.

Apparently, (if you're a well-connected, rich Repuke), you have to be charged with a crime for the prosecution to gather enough evidence to charge you with that crime . . . :silly:

5. You mean to tell me the police can not question witnesses until a person
is officially charged with a crime? This is total BS because they do it all the time. That is how they get evidence to charge a person. This judge is obviously a right wing shill.

10. This was about Dr/patient confidentiality - and like ACLU, I'm on
the same side as OxyRush - I don't want the police to know what my doctor thinks about whatever. Now, if they think they have enough evidence to charge me with something, then the judge could allow limited conversations - and in this case stated pretty clearly that dr/patient priveledge didn't extend to covering up a crime.

The way the ruling in made requires the police to make some showing that there has been a crime, that the Dr was part of it or should have known it was going on.

Just keep your mouth shut when being arrested or in custody, and remember: nothing is off the record when talking to police.

13. Hmmm I just read an article in LBN that refutes this whole thread
The judge ruled that prosecutors can depose doctors and staff if it is relating to a crime just can not see medical records.

14. No, both articles talked about the judge allowing depositions from
the doctors, this one just points out that she also required there to be criminal charges in place. There have already been parts of the medical records released to the prosecutors by same judge
