The only real deterrence against spying on citizens is the fact that the evidence gathered in illegal searches aren't admissible as evidence. Cops walk the line to keep cases from getting thrown out of court.
But the Bush adminstration believes that Bush can jail any American citizen suspected of, well, something without trial, indefinitely, see Padilla v. Rumsfeld. There's no need for evidence, admissible or otherwise. (Bush also believes that his national security powers allow him to break the law without informing congress)
Ergo, there's no reason for the Bush adminstration to hold off on illegal searches, spying, whatever. There's never going to be a court throwing out evidence as illegally obtained because there will never be a court involved. If they determine to jail somebody, they will be jailed, no trial, no court, in fact no charges. So spy away.
