CNN senior legal analyst Jeffrey Toobin said the president's authorization, and subsequent re-approvals every 45 days, might lack legal merit.

Q: Who gives the court orders under FISA?

TOOBIN: The FISA court is a rotating court, with the judges appointed by the chief justice. There are no defense lawyers.

Q: In your opinion is the president on firm legal footing?

TOOBIN: I think he is on questionable legal footing because he did not seek court orders, which are easy to get. The key question is why didn't the president go to the FISA court? It's a virtual rubber stamp. The president says he didn't always adhere to FISA because the terror threat is so fast moving and there's no time to wait.

But you can actually get a court order from the FISA court retroactively, so it's hard to see what is slowing things down. Also there have been 19,000 court orders approving wiretaps from the FISA court since it started in 1978, and only five have been turned down.

Q: Does any part of the Patriot Act justify the taps?

TOOBIN: The Patriot Act amended several national security laws. I wonder why they didn't amend the law requiring you go to FISA court at that time.

5. With only five denials in 19,000, is the FISA court a mere rubber-stamp
rather than a safeguard to civil liberties? Wonder how many times in the reported 30,000 instances without a warrant national security were an issue and how many times partisan politics/dissent were the issue :shrug:

6. A bigger issue.....Who were they spying on
that it was not even an option for the FISA? Were they self-serving wire taps???? Political Opponents, Journalist, CIA Operatives? This is ultimately what they really are covering up. This is way bigger that the Valerie Plame outing.

This is my intuitive feeling.

7. no time to wait? hell how long does it take for chimpy to sign off
on one of these things - hell someone with the right clearance needs to type up the request - and then get into the oval office. Granted the ape doesn't do much but he's very defensive about getting his nap or exercise time being infringed on so you'd have to make an appointment - I can't imagine someone breaking in on Chim chim waving a piece of paper in his hand to sign. And of course once this is signed it has to go the person who will implement it.

So how is that faster than using FISA?
