I heard some wingnut on CSpan this morning make the claim that the numbers found on a suspected terrorists cell phone cannot be used or called . She (Victoria Toensing) made the claim that they cant use them because its not enough that they are on a terrorists phone. They needed more evidence to issue warrants. Is this true or is she blowing smoke up asses like I suspect?

if the phone is obtained constitutionally, then they are fair game. If your drug dealer, for instance, has your number on his cell phone, and he gets busted, expect a visit.

If the 'suspected terrorist' is simply vanished, without legal procedures being followed, or if his phone is stolen by the feds, then the numbers cannot be used in court.

it's called the fourth amendment.

4. I just watched that. She's full of hot air. Bamford was pretty good in
explaining what really is going on.

To me if you find a TERRORISTS phone, wouldn't that be probably cause? Or if you just find Joe Sixpack's phone and want to do a fishing expedition to see if he MIGHT be a terrorist, or listen in to whatever else might interest them, they might have trouble with that.

Besides, this hypothetical of hers is a straw man. FOREIGN surveillance is pretty wide open, they don't have to get warrants. Bamford kept bringing that up and she just ignored it.
