2. Bull fucking shit. Bush had to get a Declaration of war from Congress
and he didn't do that. The IWR is not a Declaration of war. It's a declaration to fight terrorism. WTF is wrong with Biden? Does he really believe he could be president? Fat chance.

4. All the DLC apologists on this board - what say you?
I wonder if Joe plagiarized that comment or thought it up all by himself.

10. Are you sure?
If so, I stand corrected, but I was pretty sure that Joe for the most part played by the DLC handbook.

11. No, he's just owned by MBNA

You don't need to be a damn DLCer to be bought and sold by special interest money. Why people put more emphasis into the power of the DLC way beyond what it truly has is beyond me. It's become the liberal bogeyman of the left half of the Democratic Party.

http://en.wikipedia.org/wiki/MBNA

Individuals at MBNA have been strong financial supporters of the U.S. Republican Party. As a group, employees of MBNA are the top all-time campaign donors to George W. Bush, and over 80% of the political donations made by MBNA employees and its PAC go to Republican candidates. A few critics of the Republican party and of MBNA have organized a fledgling boycott of the company. It does not appear to have had any effect. MBNA was one of the prime movers in lobbying for the passage of the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005.

As of December 15, 2005, the Federal Reserve Board gave final approval to the merger between Bank of America and MBNA. The merger is expected to close on January 1, 2006.

7. Biden is a pathetic fool who personifies the old adage that the most
Edited on Wed Dec-21-05 05:52 PM by Vinnie From Indy
dangerous place to be in Washington is between Joe Biden and a TV camera. How hard is it for Rove to control the debate in America when the only thing he has to do is get his media bitches to perpetually pick guys like Biden to come on the idiot box as the Democratic response. It is a tragedy.

8. I believe he was stating that to show that * had 15 DAYS not 72 hours
to go back for a retro-warrant.

So they have NO F-ING excuse for not getting a warrant. Except the old: "We didn't want you to know who we were spying on" excuse.

12. Right... but the smaller issue to me outside the context of the FISA
argument is.... IS the Declaration to use Force equivalent to a Declaration of War? I didn't think it was.

13. That's what I heard
That there was no reason at all for Bush not to get these warrants. I thought he did a fairly decent job today, all in all.

17. I Was Just Discussing This...Let Boxer's Scholar's Decide
I'm sure someone will bring up the fact that Lincoln overrode habeus corpus...or the right to a speedy trial, during the civil war or that German and Japanese American citizens were spied upon during WWII...BUT, that was under the basis that there was a true Declaration of War issued by the Congress and under this authority these actions were judged to be permissible.

The IWR is NOT a declaration of war...as much as the Tonkin Gulf resolution. This was authority to use force as a last resort specifically against Iraq. There was no mention of Al Queda or any other link that could have been stretched to allow any domestic spying unless, possibly, it would have been on the Iraqi mission to the U.N. (which I'm sure was done and could be done under the NSA's normal modus operendi).

The legality of these actions are so blatantly unconstitutional it demands some type of action. The short-term of derailing the Patriot Act is a side benefit...but the entire scope of this regime's law breaking is now in the open and must be investigated and Democrats must use filibusters, quorums and other actions to force this to a head at the outset of the next Congress. Screw ScAlito...the investigations start NOW.
