3. That was the risk they took when they filed their briefs
They wnated the charges thrown out. The judge threw one out but not another. That was the risk they took.

It's their own damned fault. They could have fought both charges head on in a court of law, but chose to begin their speedy trial by filing the briefs to have the charges thrown out.

His speedy trial began as soon as the brief was filed.

DeLay's request for speedy trial denied

By JANET ELLIOTT
Copyright 2005 Houston Chronicle

AUSTIN - - A state appeals court has rejected motions filed by U.S. Rep. Tom DeLay to help him get a speedy trial, an essential step in the Sugar Land Republican's efforts to regain his congressional leadership post.

In an order made public today, the intermediate appeals court rejected DeLay's bid to be tried on a money laundering charge while prosecutors appeal the dismissal of a related charge accusing DeLay of violating the election code.

The panel of two Democrats and one Republican also overruled a motion to expedite the appeal by shortening the time for filing briefs from the customary 20 days per side to five days.

12. "two Democrats and one Republican"...
...DeLay will, of course, appeal the appeal claiming he didn't get real justice because two of the judges weren't Republicans.

8. Link! (Reg. Req'd, sorry)

(Snip)
Time may have run out on U.S. Rep. Tom DeLay's quest to be tried on money-laundering charges before Congress begins a new term in late January.

The Third Court of Appeals in Austin refused Thursday to intervene immediately in DeLay's request to be tried quickly on the first-degree felony charge. The appellate court also denied DeLay's request to speed up the exchange of legal briefs on whether DeLay can get a quick trial.

The decision means DeLay's trial might be postponed for weeks, if not months, and Congress likely will begin a new term in late January without the Sugar Land Republican reclaiming the U.S. House majority leader post.

However, a statement from DeLay's office Thursday suggested he will now ask the Texas Court of Criminal Appeals to intervene.

"The court's decision allows Mr. DeLay the opportunity to move past intermediate courts and go right to the highest appeals court to make a case for dismissal of Ronnie Earle's baseless charges," said DeLay spokesman Kevin Madden in a written statement. "Mr. DeLay remains confident that we can continue to move the legal schedule rapidly towards either dismissal or a trial sometime in January."

If he get's his position back it will only be for a short while. With Abramoff, he is basically the top of the food chain so if he goes down on that, he will do time.

He wanted everyone to have Happy Holidays. So sweeeeeet of him. ;)

I wonder if the House of Representatives will STILL postpone their return? Remember they were giving the Hammer extra time for his trial? This puts a nice little wrench in that plan.

27. I think judges in general are alarmed and pissed off about this
whole secret wiretapping stuff. They KNOW it's not the spin being put out there - it was the Executive branch telling the Judicial branch - Fuck You, you are no longer relevant.

No one likes their turf being torn up, me thinks judicial rulings are going to be a little tighter than they may have been - less giving of the benefit of the doubt to these arrogant, corrupt ReThugs.

Hey Frist, how's that stock investigation going?

KKKarl, did the GJ meet yesterday? It was Wednesday. Think Fitz is going to give you a call in the morning to tell you to go ahead and hand in that resignation before his news conference? Or let you sweat it out til New Year's?

Ney? Heard old Ambrohoff is about to start squealing - Big Daddy in the WH probably won't get a chance to pay you back for throwing your state his way, huh?

And copping to $2.4 million in bribes Duke? Wow, there must be more that got negotiated away - who you taking down with you?

That's right - y'all just keep up that "judicial activist" refrain - get them shouting it from the pulpits, the roof tops and FAUX news. Keep these judges pissed off, right before you get in front of them and try to lie and spin your way out. It's like waving that steak in front of a dog that you've had tied up and been starving for quite some time.
