well, he's been droning for a couple minutes now... He started off trying to tie into what Reid was saying about how he, too, is concerned about things like jobs and problems - but then he started complaining that he's there to do something about it rather than just complain about it.

Of course, how he's doing something about it by wasting everyone's time with this publicity stunt was beyond him.

Now he's talking about the way to grow jobs is to perform his constitutional responsibilities. I hear that, and all I can think is - My God - what an amazing loss for the people of Minnesota. Wellstone's shadow must haunt this poor man, the shoes will certainly never fit.

74. I am not watching, just listening, so the combover
is not distracting my attention to his words. He is doing the party good by shooting down the Repub foggy words about how they did not fillibuster any Democratic Judge nominees.

I love it when Democratic Senators get equal time, they will win the argument every time.

75. Refutation of the Rogers-Brown 76% figure
In California, nominees for the Supreme Court do not run
against opponents; the vote is either For or Against.

8,621,121 Votes Cast

Counting all 8,621,121 votes cast in California, one does not
see a groundswell of support for Brown. Rather, one sees her
pulling out a narrow victory against the 49.23% who either
didn't want her or didn't care enough about her nomination to
vote one way or the other.

In fact, of all the four judges up for election that year,
Brown had the highest "non-vote":

Chief Justice George: 2,452,648 
Justice Brown: 2,855,515 
Justice Chin: 2,551,934 
Justice Mosk: 2,723,193

The "76%" figure only comes up when you don't count
the nearly 3,000,000 people who voted neither for or against
Brown.

78. As for Priscilla Owen
Her 84% figure is, at first, a harder figure to refute. Candidates for the Texas Supreme Court do have opponents. Judge Owen did, in fact, win 84% of the vote.

However, here are the results from that 2000 election:

Priscilla Owen REP 3,860,541 84.26%
Joe Alfred Izen, Jr. LIB 721,034 15.73%

Some of you may be wondering where the Democratic candidate is. He/she isn't there. The Dems didn't run a candidate against Judge Owen (or against any Supreme Court Justice). Instead, her only opponent was a Libertarian. No Libertarian that I have found received higher than 19% of the vote in Texas that year.

So, why did 84% of Texans support Judge Owen? Because they didn't really have any other choice.

I knew the figures were bogus; I was just too lazy to do the research.

The Owens numbers are an illustration of some facts that are getting "overlooked" in the fair and balanced presentation of our dear friends on the other side of the aisle:

1. In states where judges are elected, they very frequently run unopposed.

2. In the State of Washington (and, I suspect, in most states, since rules of judicial conduct are pretty much standardized), there's no meaningful campaigning by judges, since they can't campaign by promising to rule certain ways on certain matters; in fact they can't say much of anything meaningful. So even when there's opposition, it's not as if the public is voting on a full understanding of the issues.

3. Thus, most people vote for judges because they're standing there in the voting booth, there's a race to vote on, so, what the hell, punch it. (This would be the Brown effect.)

All of which points up the fact that Republicans are utterly conscience-free when it comes to making a good sound bite, and they're well-tuned to the fact that if you say something that sounds pretty good, no self-respecting Amurkan will question the underlying facts. Which is another way of saying nobody ever went broke underestimating the intelligence of Amurkans.

83. Arkansas ballots typically contain long lists
of candidates running unopposed. All you can do is vote Yes or No, or leave that part blank.

The research was no problem; all I did was just look up the official election results.

80. Senator Pryor does not fill me with pride
I've seen him speak two or three times during the last several hours, and all he seems to do is stand up and thank people. This is the Senate, Mark, not the Oscars.

I voted for him in '02 (warily, I admit; one of his campaign points was that he "supports President Bush in the War on Terror"), but if he's going to behave like this every time he speaks, I may be reluctant to vote for him again.
