Janklow to Resign Effective January 20, 2004
"I wish to inform you that because of present circumstances, I will be unable to perform the duties incumbent on me in representing the people of South Dakota as their U.S. representative," Janklow wrote in a letter that he said was to be sent to House Speaker Dennis Hastert on Tuesday.

"Therefore I wish to inform you that I will resign from the House of Representatives, effective January 20, 2004."

That's the same day that the House reconvenes for the Second Session of the 108th Congress.

13. Janklow's Replacement Won't Be Appointed:
Governors do not have the power to appoint Congresspeople. When a vacancy in the House occurs, the constitution tells the Governor to issue a writ of election. In other words, they'll be a special election in mid-Spring for Congress in South Dakota. Likely candidates: Jim Thune (R-former Congressman); Stephanie Herseth (D-ran against Janklow last time, and got 47% of the vote).

This one is a toss up.

16. That sounded like the plan
if he doesn't run, the Republicans really do not have a strong candidate. I just hope that the people of SD give Stephanie a chance this time. Even if Thune runs I'm predicting a close election...Stephanie should have a great chance of winning.

23. I'm surprised and happy
justice was served in this case, I really didn't expect it. This should really help the Democrats take this House race now, it was close before.
