Legal question, would like some input/opinions
This nightclub that I usually go to has this dress code.. If you're a male you have to wear a shirt with sleeves. My question is, do I have a case based on gender discrimination because there is no dress code for women. They can wear the practically next to nothing. When I go out I usually wear a tank top especially in this club because it is small and gets really hot inside. Now this is not some fancy club or anything, it's just a basic hip hop club... younger crowd so it's not like the dress code is for class or anything like that. The bouncer told me that the tank top/sleeveless shirt for a male creates an aggressive look that starts fights. I was laughing my ass at that... told the bouncer that the combination of alcohol and bad attitudes will probably start a lot more fights then a simple white tank top.

I was thinking of contacting the Maine Attorney General's Office and see if they have some kind of civil rights division. This just came to mind to check into this with the recent NJ ruling about there nightclubs. I do believe that the state made our only strip club hire male dancers as well because they said it was discrimination.

Just was wondering what people's opinions on this are.

2. you have a good enough lawyer
you got a case. IMO, in this country and these times, it isn't the merit of a case, its the "skills" of the attorney.

I'm not commenting on the legal aspects, but IMO this lawsuit would be completely and totally lame. Men claiming "reverse discrimination" are often pathetic, to sue over something this trivial would be worse than that stupid NJ case, recently.

4. Well, some guy won a lawsuit claiming "Ladies night" was discriminatory
but I have to agree with DTH, this would be a rather frivoulous lawsuit.

5. It's a private club, a business.
They can have any kind of dress code they want for the customers. A dress code for the help is another story..

6. I'm a paralegal but I will point out a few things to consider w/o really
speaking about the points of the case. No attorney is going to take this on a contingency because there is no monetarty payout. If you win , you get to wear your tank top, but get no money as money is not involved here. So be prepared to spend $125-300 an hour for attorney fees which will rack up real fast. This would be a state issue and Maine would not be bound to follow or even give any credit to any other state's rulings if they did not want to.

Best advice-find another club!
