A MAN who said he accidentally strangled his wife with a telephone cord during sex has been sentenced to five years' probation in the US.

Joseph Micale, 35, was charged in December with reckless manslaughter in the death of his wife, Maureen, 37, and could have faced 15 years in prison.

But he pleaded guilty to the lesser charge of criminally negligent homicide, and prosecutors agreed to recommend no jail time if he surrendered parental rights to his one-year-old son to the boy's maternal aunt.

"My wife and I participated in what we thought was harmless, alternative sex and it went terribly awry," Micale told the judge in Syracuse, New York.

"I lost her, too, as well as my family."

I can't believe someone can strangle their spouse and get no jail time.

I'm not some prude. But, his wife died. Yes, you can be charged with a crime even if you did not intend to kill someone.

I did read the posts. I'm not a moron. I never said it should be first degree murder or anything. But, I'm not some kind of frigid wing nut because I happen to think that killing your spouse, even accidental by strangulation should merit more than a slap on the wrist.

The whole story is sad. I can't believe I was basically accused of prudishness upthread because I think this guy was negligent in his wife's death :crazy:

I got accused of being a prude several times on the various threads about sexism.

Something just smells funny about this situation. The fact that he tried to hide what happened bothers me. I can see why he would if it did happen like he said. It's an embarassing thing to admit. But once he tampered with the body we may never know what really happened.

Does anyone remember that story years ago about a couple having sex on a hotel balconey and she falls and dies? And now a man strangles his wife during sex. My guess is that if you have to do dangerous stuff to get off, then you're not doing it right.

It also could be a way to commit murder, and get away with it.

either he was inexperienced and didn't know what he was doing...in which case he's an idiot and shouldn't have been engaging in that particular act because it's dangerous. Or...he was experienced and did know what he was doing and was either negligent or (goddess forbid) he killed her on purpose.

I really hope it was the former. For his sake and the kid's. But it should be a lesson to people...do not engage in dangerous sexual activities if you don't know what you're doing.

We're somewhat playing that telephone game, since this is an Australian newspaper reporting on a New York state story. Be that as it may, only a minority of folks interested in breath play are women -- it is usually about the man's orgasm -- which may seem a funny post to read from me if you have read my other posts on this topic but...we have too little information. Based on the short article I just read, I would guess the man has just gotten away with murder, as I'm seeing no evidence that this woman was getting off on being strangled with a telephone cord. But this is a short report, and perhaps there is indeed good evidence the man just made a stupid mistake.
