Legal question about a tree.
Our concrete driveway is starting to crumble by the house. We are going to get an estimate to fix it but my fear is that tree roots from the neighbor's tree may be the culprit. If the roots have to be cut under the driveway then this will probably weaken the tree and make it more susceptible to falling on our house. If the tree needs to be taken out, whose responsibility is it - ours or the neighbors?

1. What kind of relationship do you have with your neighbor?
I had a similar situation in my house and we came to terms on it very amicably. I'd start off with a friendly discussion on it and see where it goes from there. Good luck. :hi:

3. Not very good.
We have been here 17 years and kept our distance. It is like Ft. Knox over there. They own a gun store and someone broke into their house a few years back and got $80,000 worth of guns. Who knows what they missed. They had this awful kid who was always shooting up our trees with a rifle and shooting arrows in our yard with his bow and I was afraid he was going to impale one of us. They usually had a deer swinging from a tree. I got pissed at the kid when we moved here because he would keep pulling my 3-year-old's pants down outside (he was about five years older). We talked to him to no avail and finally talked to the mother, who told us we had him mixed up with another kid (it's that one there sitting on your couch). So things have been fairly frosty, although we just quietly go our own way. So I doubt we would get much cooperation. They have the lone Bush sign amidst all the Kerry signs in the neighborhood.

5. Too bad you didn't set up a video camera
neighbor kid mighta been let out of juvi after a few months.

At least, you would have had evidence of the kid's predisposition for crime . . .

2. if a tree falls on your neighbor's house after you have fixed the
driveway and noone's around to pay for it, would your neighbor make any sound?... :evilgrin:

4. here in PA
my husband maintains that when the tree affects your property, it is your problem, since what it is doing is on your property. Seems unfair, but that is what I have heard. Might want to check regulations in your state.
