My employer didnt pay me
Ex-employer that is. Who do i talk to about this? Better Business Bureau? A lawyer?

That's where I went when that happened to me. Got it straightened out too. But I had timecards as proof of my work.

3. I have no time cards
I turned them in to him and he never did bring my W2 for me to fill out. I do have a couple of guys who work for him that will vouche for my being there.

5. Is your employer still in business?
If they are, I'd call them daily and ask them where the money is. If they are out of business, that is why it is important to be payed in a timely manner. My friend's father worked for a small company that did not pay its employees for a couple of months and then promptly went bankrupt and they lost that pay for good. I worry the same thing will happen to my husband. His boss often pays in a week or two late and has been late over a month.

6. You can sue him in Small Claims Court
locally if the total amount of wages is less than $5000. Go to the county seat in the county where your job was and go to the clerk's office. There will probably be pamphlets describing what steps to take. It's really rather simple. You write out the complaint yourself, pay the filing fee, pay a fee to have the Sheriff serve the complaint, then go to court on the "return" date and if he shows up, set it for trial. Chances are he won't appear, but if he does make sure you line up your witnesses for the "trial" (which is actually much like "People's Court" in a lot of ways). If he fails to appear, you ask for, and will be granted, a "default judgment" and you can then subpoena him in to "discover assets." It's easy, and if you like to argue, quite fun, to boot.

12. Yes, small claims court is the FASTEST way to get the cash you're
owed.

File right away, don't wait. FIRST send him a letter, registered or certified, demanding your money, THEN file in SC court.

You must have first presented him with the opportunity to pay you. Then when you aren't compensated, sue him.

Don't mention the SC suit in your letter. Just make the demand, plain and simple, no excuses, no reasons, no drama. Even present a plain and simple invoice.

It takes time though and a hearing. If you know a lawyer, a call from one is usually effective. They know what to say. If you don't have one in the family make sure you don't pay the lawyer for more than your check. Sometimes university law schools can point you to store front lawyers, who donate their services, if you are pressed for money.

9. That happened to me once
when I worked at a small ISP. I ended up carting home a few computers then quitting. I told him he could have his computers back when he gave me a cashier's check for my pay. It worked, but he probably could have had me arrested if he wanted to.

Oh, and after I quit I found out he wasn't taking taxes out of my paychecks. What a bastard.

10. I am an independent contractor and am currently waiting for an
$800 check that's been owed me since May. Right now, it looks like my option is small claims court. Good luck to you and I hope you get paid soon!
