2. A lot of municipalities have this kind of law on the books
It was designed to stop bank robberies. During the late sixties, early seventies, a popular bank robbing costume was a NIXON mask.

Nowadays, though, it might be used as a vehicle to screw with people, who knows?

It's not clear whether people have a constitutional right to anonymity in public.

4. This kind of law is not uncommon
New York City and many other cities have had no-mask ordinances for decades, back to the 50's and 60's. In some places, probably including West Virginia where this occured, these laws were enacted to put a stop to KKK mobs.

6. A friend of mine
Was hassled by the cops but not arrested pre-Shock and Awe for wearing a Grim Reaper costume and carrying an anti-war sign. Crazy thing is now he's a pro-war pro-Bush supporter. I can't explain it.

Police say Gray took the mask off and asked why he couldn't wear it. After officers told him that wearing masks in public is illegal, he reportedly put the mask back on and said he didn't believe it.

Gray was then arrested and the mask confiscated.

Wearing a mask or hood in public is a misdemeanor under West Virginia law, punishable by a fine of up to $500, up to a year in jail, or both. Prosecutors say masks can hinder efforts by law enforcement officials to identify criminal suspects.


The intent of the law is to aid in identifying suspects. In this case, they saw what the person looked like after he removed his mask. There isn't any mention of any criminal investigation ongoing in the area that required knowing his identity.
