It wasn't a sexual assault -- it was sleep sex.
Edited on Wed Nov-30-05 04:42 PM by CatWoman
In an unusual case in a Scarborough, Ontario, courtroom, Jan Luedecke was acquitted of sexual assault after a judge ruled he was asleep during the attack -- a disorder known as "sexsomnia."

"This is indeed a rare case ... His conduct was not voluntary," said Justice Russell Otter, as Luedecke's victim shook, sobbed and then left the courtroom.

The judgment has outraged women's groups.

"This is infuriating. It's another case of the courts not taking a woman seriously, adding yet another list to the list of excuses which men use for sexual assault," said Suzanne Jay, of the Canadian Association of Sexual Assault Centres.

He guided me back to bed. Don't ask me how.

Needless to say, I was buck naked.

teen girl climbs 130' crane, then is rescued while still sound asleep.

if you can climb a crane then is it so outlandish to think this guys defense may be legit?

41. Well, apparently this is the real deal as far as a diagnosis goes
<http://www.sleepsex.org/>
<http://www.webmd.com/content/article/14/1687_51690>

However I find this particular case a bit hard to believe for one reason, the man put a rubber on. Somehow I don't think that if he really did suffer from this condition he would stop and put on a rubber. But hey, this is the first time I've heard of such a diagnosis so:shrug:

44. Hard to say I suppose
I had a roommate who (every once in awhile) when drunk would go into a different roommate's room, open his closet, lift the lid on the hamper just like it was the toilet, and pee away.

I try not to get worked up over these kind of court things. I'm sure there was SOMETHING that made the decision seem apropriate, and in any event my input is meaningless.

My roommate had a predelection for opening chests of drawers and trying to piss in them.

He also got out of bed, walked over to his couch, and pissed all over it!

I must admit that I also once fell asleep after "the act", woke up to take a pee, and realized much too late that I still had a condom on. Damn thing started filling up like a water balloon!

56. I immediately thought "twinkie defense"
But who knows? We men are such simple animals, I could beliee that it's possible to attempt it in our sleep. I had a college roommate who walked and talked in his sleep which was very unnerving. I don't find it *that* impossible to believe that one could animate the most basic behavior essential to the survival of our our species.

But I would like to here the expert testimony. Otherwise it seems to open up a huge loophole, ala the "the twinkie made me do it!"
