Are headshops illegal throughout the US?
I just googled headshop looking for something, and the only ones I could find were in Europe, are we back to the days of stuffing a kazoo full?

They operate under the legal fiction that you will be using that skull-shaped bong water-pipe for tobacco or another legal drug.

2. No clue, but they operate with impunity here in CT
the indie music shop I go to buy my vinyl has a display window of bongs, pipes and narghil labeled "for tobacco use only". I just don't think anybody cares here. I don't know about availability anymore but in HS we used to buy "tobacco" smoking accessories at the mall.

6. No, not at all
The laws vary on a state by state basis, but here in Missouri we have headshops operating in all major cities, and even some smaller towns. However they're euphimistically termed as "tobacco shops" or "smoking accessories". And when you do find one, don't walk in and announce that you wish to purchase a bong, they'll kick you out but quick. The proper terms are tobbaco related, like water pipe, etc.

9. We used to have a top of the line
headshop in St. Joe, I could spend hours in there, they ran it out of business back in the early eighties, since then I've only seen small display cases in used record stores.

20. If you head into KC
You could always hit Seventh Heaven, both in KC or BlueSprings. If you're in the Columbia area, check out Aardvarx. If you're in Springfield, I know there used to be a shop on Battlefield, but it may have gone out of business in the past ten years. In St. Louis county(Florissant) you can find Hypnotized Smoke Shop.

16. Possession of drug paraphernalia
It's a crime to have paraphernalia, but it's okay to have shops that sell it. What am I missing here?

IMHO possession of paraphernalia might support reasonable cause for a search (maybe), but should not be a crime in itself. I've also heard of arrests for possession of burglar's tools. What would that be? Stuff from the Ace Hardware?

since the feds have cracked down on paraphernalia shipped across state lines. You're much better off going to your local head shop.

22. It's not paraphernalia if used for tobacco purposes...
thus, a shop can sell you a glass pipe or a bong, as long as you say it's for tobacco purposes. It only becomes drug paraphernalia after the cops find you carrying it around with marijuana residue in the pipe.

they are illegal federally, so the feds have busted most of the ones that deliver across state lines.

On a state-by-state basis, many states have cracked down recently, following the lead of the feds in their Operation Pipe Dream (which saw the arrest of Tommy Chong).

So, it depends what state you're in.
