but the bottom line is if she was legally married how can the family take over her home and other assets she shared with him?

You see folks this is what happens to gay couples who can't get married, Gays have a slim to none chance of getting any of their property or financial assets out of a longterm relationship....if their partner dies and they didn't have legal documentation stating what assets go where...
