you are not obligated for the debts of others, so there is no legal way to make the victim pay these bills nor would the victim need to declare bankruptcy -- this part of the story makes no sense whatsoever
there is more to the story, in the cases i've known about like this, the victim and the thief were close relatives, and the creditors figured that the "victim" claimed her identity was stolen by the "thief" in order to get out of paying the bill
not say that this is what your friend has done but it is extremely odd that the victim would need to declare bankruptcy when she is not responsible for some stranger stealing her identity and running up these bills
maybe she should get a lawyer who knows what he's doing, isntead of a lawyer that happens to be her dad but appears to be unknowing of even basic consumer rights
in all cases i know of personally where the victim was truly a victim and still had to pay the bills run up by the thief, it was because the thief was a blood relative (daughter, son, or daughter-in-law) of the victim and it is difficult in these cases to prove the thief really stole the money as opposed to getting permission from mom or dad
i'm not completely unsympathetic, in fact, i'm very sympathetic, as it has happened to us also, however, in all cases, where my husband or my identity was stolen by strangers, it was quickly and efficiently handled with no real cost to us other than a few bucks spent on a notarized affidavit telling the credit company our side of the story
same with another friend whose identity was stolen for a hotel clerk's wild weekend in vegas, his card was replaced by a new one in 24 hours, now, it is true the thief's account remained open, but it was changed to her real name and she had the option of either paying the bill herself or else face prosecution, i don't know which she chose as we never heard any more about it, and my friend had the bills removed from his account in a few hours and he has never been re-billed again and it's over a year now...
everybody gets their identity stolen at some point and the country would be in chaos if it were really all THAT hard to fix 99 percent of the time
it is good your friend is working with the sheriff but she also needs to report these businesses to her state attorney general's offices if they are billing her for money that she doesn't owe
