Tax Question - What if an employer doesn't pay the taxes?
my spouse worked for a guy who it appears did not pay the feds or the state the taxes he took out of my spouse's paycheck.

what can we do?

the W2's made it appear that he had, but he called us to tell us that "sorry...but I didn't pay"

3. he just confessed this to us, do we have to call the IRS or will
they do this on their own?

We called the IRS and Social Security and their reps seemed useless about this situation.

6. Just file your return.
Add a note saying what he told you just to document it.

10. Social Security can help
If it turns out he did not report your wages at all.

Social Security will credit you based on the W-2. IRS will be notified, and they will go after the employer for taxes and non-reporting.

You may have to wait until next year to do this, because SSA doesn't act until after the date that your wages should have been credited to your SS record.

Happened to my BIL.

The IRS told him that his employer, not he, was responsible.

7. yes and it appears his wife is trying to re-mortgage their house
to pay other bills.

this individual is a first class dumbass and con artist.

he is currently hiding out in a "treatment" facility where he thinks he is "incarcerated". However a place that you voluntarily admit yourself and that provides therapy sessions in a deluxe setting doesn't sound like incarceration to me.

9. You paid your taxes
They were deducted from your check. Bozo failed to send them in so he's in violation of the law. As long as you have your check stubs and/or W2 , you're fine.
