"Liczbinski Law" pushed
"Liczbinski Law" pushed
by brian x. mccrone / metro philadelphia

JUN 5, 2008

PENNSYLVANIA. Despite recent failures in Harrisburg to enact stronger gun laws, state Sen. Michael Stack said yesterday that he will introduce two anti-gun violence bills, including one he hopes to name after slain Philadelphia police Sgt. Stephen Liczbinski.

The “Liczbinski Law” would require mandatory 20-year sentences for anyone who uses an assault weapon in a crime, like the Chinese-made SKS assault rifle that a bank robber killed the officer with.

Too bad this law will not even address the ridiculous 44 year early release of repeat offenders that kill cops, like the one the killed Liczbinski. (you read it right, the triggerman in the Liczbinski murder was released 44 years early,)

What is going through the heads of these people?

1. By what definition is an SKS an assault weapon?
Edited on Thu Jun-05-08 01:39 AM by krispos42
Keep in mind that an SKS is identical in every feature to an M1 Garand rifle.

  • Wooden stock

  • Inline grip, no protruding or thumbhole grip

  • Semi-automatic only

  • Fixed magazine

  • Ammunition loaded via a disposable clip through the open bolt

  • 10 rounds or less capacity

  • bayonet lug or integral bayonet.

  • Wooden barrel shroud

Ridiculous.

2. To the uneducated it looks like
but operates nothing like, an AK-47. That's all. Looks 'scary' or 'thuggish'.
Generally I consider 'size' a feature, and those pictures aren't to scale... En-bloc versus stripper clips. Otherwise, your comparison is pretty damn adept.

I don't have a problem with the increased penalties for using a firearm in a crime though. My only concern here is later grief when society figures out these 'assault rifles' aren't really any different than any other rifle, and suddenly we have a sentencing disparity, like we see with cocaine versus crack.

That early release is sickening. Way to dishonor the memory of a slain police officer.

10. No, they're not to scale,unfortunately
Both are still considerably larger than a handgun, though. I think DUer benEzra has a picture floating around of his wife's SKS and S&W "Ladysmith" pistol for size-comparison purposes.

Wikipedia gives the following numbers:

M1:
Weight: 9.5 lbs.
Overall length: 43.6 in.
Barrel length: 24.0 in

SKS rifle:
Weight: 8.5 lbs
Overall length: 40.2 in.
Barrel length: 20.5 in.

11. Odd
I thought the SKS was much shorter than that. I can't believe there's only a 1lb difference between the two, just considering the manner of construction. SKS is much bigger than I thought.

Wild. Very comparable rifles, aside from the 39mm/308 issue.

3. How emotional
The “Liczbinski Law” would require mandatory 20-year sentences for anyone who uses an assault weapon in a crime, like the Chinese-made SKS assault rifle that a bank robber killed the officer with.

Why not a mandatory 20 for anyone who uses a firearm in a crime?

5. What kind of crime?
If you have an "assault weapon" in your trunk and you are found guilty of a minor crime, do you get 20 yrs?

7. I was speaking more if the firearm was used in the commission of a crime
so no mere possession by a person charged with an unrelated crime isn't what I was suggesting. I can't figure why they would make the sentence greater for an 'assault weapon' than any other firearm...but it feels good to some I guess.

4. Legalislative thuggery
This is the danger when states are allowed to pass firearm laws out of emotional situations.

I guess the M1 carbine will probably end up classified as an AW, or the German G43, or the Rusky Tokarev.

Sheer nonsense.

6. How about a 20-year sentence for anyone who commits a violent crime?
Edited on Thu Jun-05-08 10:10 AM by slackmaster
Or maybe, for any crime that results in great bodily injury or death, or some other legalese?

I'm having a hard time imagining, to paraphrase George Carlin, a criminal saying to himself "I'm gonna go shoot some of those annoying kids at the school bus stop but I'd better use the shotgun instead of the SKS. I wouldn't want to get in TROUBLE!"

8. Well, let's tell this A-Hole what we think of this law! How can we get in touch with this...
Supergenious? These guys come up with these ridiculous laws and we just stand by bitching about it. I'm tired of watching my liberty slowly washing down the river. What's the number to this guy's office? Email?

When it's too late, we'll realize we should have done more.

9. Each sentence for possessing a firearm when committing a crime must be served sequentially with
any other sentence.

If sentences are served concurrently they are IMO relatively ineffective.
